Can I buy my way out of Probation? ~ Best Answer on AVVO ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Q:     On probation for 1st offense DUI prior question asked was buying out probation.  I'm just starting my probation and I asked a question about buying out my probation. The advice I got was I could possibly buy out the cost of supervision. What exactly does this mean?

Answered . You can try to "buy" some or all of your community service hours (some Judges permit it, some don't, some permit 1/2 other not - its completely discretionary with the court) and you can pre-pay any of your costs, fines or surcharges, but you cannot buy your freedom. Absent early termination (which is illegal in DUI sentences unless you are sentenced to more than the minimum mandatory probationary term) you will have to serve the full probationary sentence.  

Simply put, you cannot just cut a check for the time that you have to spend on probation.
