Man Lies to Cops claiming to be Denzel Washington, leading to his Arrest and a Violation of his Probation ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




Meet Justin Lee Seay.  Yes, that is him below.  Please note that he looks nothing at all like Denzel Washington:



Still, when confronted by cops Justin identified himself as the award winning actor, thereby earning himself not an Emmy, not an Oscar, but instead an additional booking count of "criminal impersonation" (he was also charged with felony drug possession and a probation violation).

In this case Justin was with four of his pals when the cops were summoned to the apartment inside of which they were being obnoxiously loud, apparently all mid-par-tay.  When the cops arrived they were overwhelmed with the stench of marijuana, so, naturally, they attempted to speak with the occupants. 





Once an officer tried to speak with someone he saw that there were several folks inside, and, more alarmingly, he noticed a "paper target with holes in it", prompting him to call for backup and for a battalion of cops to sweep the place.  Predictably this culminated in seizure of pot ("several bags of marijuana outside an open bedroom window with a missing screen").




After all occupants and contraband were secured our hero, knowing that he was on probation, gave a false name to the cops.  Probably because he was high as a kite Justin, without thinking to be less obvious, picked the first name that came to him, and also happened to be a red flag to the cops.  

Memo to the Folks:  If you get caught, for anything, please, pretty please, with sprinkles and marshmellow sauce, do not speak to the cops; instead shut up, invoke your rights and let your lawyer help you to decide what to say, if anything, and when to say it, if ever.  Each time that someone does what Denzel, er Justin Lee Seay, here did, a forefather or two rolls in his grave.






Memo about probation:  Being on probation is an alternative to incarceration.  It is a gift of sorts, albeit it is given by an Indian giver who can take it back at any time (the alternative being jail).  It behooves you to remember that at all times while serving your probationary period. It may help to think of your time on probation as walking on a tightrope.  Stray just a little to either side, lose your concentration or balance even for a moment and you fall. However, instead of landing on the ground you land in jail or prison. 

I cannot speak to any of the other 49 States but in Florida, where I have been a practicing criminal defense attorney for 25+ years, the standard conditions of probation (those non-particularized requirements which statutorily apply to every single person in the State who is placed on probation) require that you abstain from non-Rx drug use, that you do not commit any law violations and that you do not associate (be with, near, around, in the same place as...) anyone who is committing a law violation.  

Memo to Denzel:  I am a big fan.

Memo to Justin:  No one cane make you violate your probation.  That choice is yours, your's alone to make, and it's 100% on you.
