Social Media FAIL!~ Facebook Video of "Gun-Wielding Mannequin Challenge" leads to Seizure of Guns and Drugs and multiple Arrests ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1



Meet 49 y/o Kenneth White and 23 y/o Terry Brown, both of whom are from Huntsville, Alabama and are pictured below in their recent mug shots...




Both men were arrested in Huntsville, Alabama at 5:00 am on Tuesday, December 6th, 2016 after police were sent a "gunfight-themed mannequin challenge video" that had been posted on Facebook in November (you can watch the video by clicking here).




The video shows nineteen (19) people, most armed with guns, posing in what is best described as a "freeze-framed shootout". 




The video was reportedly posted on the Facebook profile of a one "Hailey Nichols" on November 9th, 2016 and has been viewed more than 4,000,000 times, including by the Madison County Sheriff's Office.  Per Captain Mike Salomonsky:  "You have a lot of people with firearms at one address and you have to ask yourself the question, "Why?" and the second question you have to ask yourself: Is it a public safety issue?"



During the ensuing month-long investigation police discovered that the house in the video was also being used to sell marijuana, and so they were able to obtain a search warrant resulting in the December 6th raid.  




When cops busted the door in the found White and Brown inside the home along with four (4) other folks, including kids.  Police recovered two (2) handguns, an assault rifle, an older single-barrel shotgun, an attack vest (a/k/a body armor), ammunition, magazines for the assault rifle, a computer, marijuana, scales and a grinder.  White, a convicted felon, was charged with possession of both marijuana and a firearm, while the younger Brown was charged with possession of drug paraphernalia, loitering and promoting prison contraband (the contraband charge came after Brown had been transported to the main prison facility at which point he was reportedly "found to have marijuana on his person").




Per Captain Mike Salomonsky the investigation continues as "[t]here are several persons in the video who may be convicted felons, so, we're going to try to do some identification, work with the ATF and see if we can generate any charges out of that."




Memo to the Folks:  Law enforcement (cops and prosecutors) can, and will, get their grubby paws on your texts, Social Media communications (posts, comments and pictures alike) and can track your whereabouts, with or without a subpoena, and any private citizen who wishes can save, store and deliver anything that they wish to either the cops or the prosecution without any constitutional consequence whatsoever.  Further, once armed with YOUR Social Media materials, if they are relevant to your case then the same will likely be admissible as evidence against your interests.  Please watch HaberPA's VideoFAQ /YouTube Webisode on "Social Media and the Law" by clicking on the video link below:

Social Media FAIL! YouTube Prankster who Videos Himself Breaking into Homes & Businesses is Digitally Served with Notice that he's getting Arrested ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1



Meet 26 y/o Jason Ethier, who goes by the YouTube handle "Jay Station" (you can access his channel by clicking here).





Jason is a wanna be YouTube prankster who apparently thinks that it is funny to film himself breaking into businesses and homes and allegedly staying overnight, but like many of his mindset ("I can do what I want") his douche baggery has apparently caught up with him as Ottawa Police have had enough of Jason and his antics and have decided that it's time to arrest his ass.






Ottawa Police became aware of Jason's videos in October, 2016 and state that they are preparing charges against him for trespassing (at best... burglarizing at worst) as he has published filsm of himself allegedly conducting his so-called "challenges" at a football stadium, an auto mechanic shop, a gym, a church, a homeless shelter, a school and even a stranger's house.  (That's Jason at a closed Dairy Queen below.)




Jason enters and then films himself trying to escape without setting off alarms or encountering security guards. 





Ottawa police have since confirmed the video of him breaking into a person's house was acually staged (with the help of the home's tenant), but he did not have permission to be in this pizza joint...

According to Ottawa Police Staff Sergeant Mike Haarbosch:  "I would suggest that he's already caught.  We're in the midst at this point of processing a number of charges, so he's going to have his day in court."





On October 27th, 2016, and in response to Sgt. Haarbosch's statement that his arrest was imminent, Jason posted a video onto his YouTube page acknowledging that the police were looking into his behavior and that they were shutting him down.  Said Jason to his "fans":  "I can no longer do these 24-hour challenges because basically I'm risking my freedom to do that and that's something I'm not prepared to give up.  I want to make it clear, when I was doing these 24 hour challenges I did not damage any property, never broke into one of these places and I never stole anything."





Memo to Jason (and his ilk):  The world is not your own personal playground you douche baggerpous little sh*t.  Grow up.  Man up.  Show some respect for, and learn how to co-exist with, others.

270 Pound Plus-Size Prostitute is Arrested in Sting Op after Offering an UnderCover Cop Oral Sex for $60 and some Nachos ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




Meet 36 y/o Crystal Hotlosz, a plus-size prostitute from Youngstown, Ohio.  That's her mug shot below....




Apparently having nothing better to do, Officer Beniston of the Beaver, OH Police Department was trolling the internet looking through "Backpage" adult classified ads when he stumbled across Crystal's adult ad for escorts. Crystal, weighing in at 270 lbs, reportedly refers to herself as a "BBW (big beautiful woman) goddess" in her online adverts and offers services at the hourly rate of $160.00.




Coincidentally, upon seeing her ad Officer Beniston reportedly recognized Crystal from an ongoing narcotics investigation, and he was also aware that she had an open and active arrest warrant.



Knowing that this would be like shooting fish in a barrel Officer Beniston contacted Crystal via her Backpage ad and a text conversation ensued.   




Texting morphed into a phone call and that call culminated in an agreement for a paid sexual rendezvous where Crystal would provide oral sex (a/k/a prostitution) if Officer Beniston brought a car (within which the act could occur), $60.00 and "some nachos".




And so Officer Beniston sat in a car park outside a Mexican restaurant (with a host of eyeball and takedown officers in a perimeter), watched a vehicle arrive (being driven by a male), Crystal exit, approach and enter his unmarked vehicle.  Once inside his vehicle the plan was confirmed ($60.00 and some nachos for oral sex), Officer Beniston tendered the marked cash, Crystal accepted, the takedown signal was given, Crystal was arrested for Prostitution and her male driver was arrested for "promoting" prostitution.




Memo to the Folks:  Sting Op” is a law enforcement term that cops use when they embrace any of a variety of deceptive tactics to catch people who are predisposed to committing crimes.  Sometimes the cops do it themselves “undercover” and other times they employ CI’s (confidential informants) or CS’s (cooperating sources). There are many sorts of sting ops.  Some examples are: Posing as someone who is seeking illegal drugs, contraband or child pornography to catch a supplier; or posing as a supplier to catch a customer (where the cops are the suppliers it is called a “reverse sting”); Posing as a potential customer of illegal prostitution; or posing as a prostitute to catch a customer (again a “reverse stiong”);  Posing as a child in a chat room to identify a potential child molester; Posing as a hitman to catch customers and solicitors of murder-for-hire; Passing off explosives, fake or real, to a would-be terror bomber; Deploying a bait car (or a “honey trap”) to catch car thieves; Arranging someone under the legal drinking age to ask an adult to buy an alcoholic beverage or tobacco products for them; or even responding to ads on Backpage.com ...   Most folks who are caught in a sting think they were entrapped but very few actually were.   The fact is that cops are permitted to  use methods of persuasion, trickery or subterfuge in an effort to get you to commit a crime.  The question that determines whether or not you were entrapped is: Would you have done what you did if a civilian had been involved instead of the cops?  Please watch HaberPA's VideoFAQ / YouTube Webisode on " What is a Sting Operation?” by clicking on the video link below:

Q:     How hard is it to get cell tower information as well as info from Apple or Microsoft?  I have a case that will require info from Apple and Verizon to prove what's happened (Cyber stalking and other crimes) There has been criminality in this long term case. My former local police refused to help me and wanted me to gather all of the evidence. They wanted an email or recording from these neighbors who lived in my community but I was never social with Cell tower info and calling Apple would prove this. Who do I ask for in Apple or Verizon? I want to get restraining orders ASAP!

Answered It is not the police's job to gather evidence for you; that is your lawyer's job.

My advise: Stop playing lawyer and hire one.

A lawyer can advise you if you actually (in the real, legal world) have any case at all against anyone and if so then a real world lawyer can help you to acquire evidence and prepare your case.

If you want to do this on your own all I can say is that you are of course perfectly free to engage on your own legal fishing expedition but, there is a solid reason for Abe Lincoln's age old quote that "he who represents himself has a fool for a client".

I would encourage you not to be that fool.
