Routine Traffic Stop Leads to Trafficking Arrest after FL Keys Deputy finds 314 grams of Cocaine Hidden in Cookie Monster Doll ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




Meet 39 y/o Camus Lorenzo McNair of Key West, FL.  That's his mug shot below...




McNair was arrested on Wednesday, July 12, 2017 for trafficking in cocaine after the car that he was driving was stopped for having an obscured license plate.  (F.S. 320.061 makes it unlawful, and therefore a legitimate traffic stop, to alter, in any way, your State issued license plate.)   By way of example, in the picture below, and even though license plate frames are considered to be "external" to the plate itself, if the frame obstructs the license plate in a way that prevents the face of the plate from being “clear and distinct” then it violates F.S. 320.061.




Anyhow, when McNair's driver window rolled down Monroe County Deputy Sheriff Orey Swilley states that the smell of marijuana was obvious, thus allegedly proving probable cause for a vehicle search.  





Memo to the Folks:  All things equal, a stop for a traffic infraction (like speeding or an equipment violation) can last only as long as is reasonably necessary for the officer to accomplish the purpose of the stop, meaning that they can run your tag, your DL and the vehicle registration, and they can check for compliance with the requirement that you carry proof of insurance, and then they can write you a ticket, but once all of that is done the lawful detention ends, and if the cops don’t let you promptly go about your business then you may have been unlawfully detained.  But, if, during the course of the detention the officer develops a reasonable suspicion that a crime has been, is being or is about to be committed (like if you were having a clam bake and s/he smells the odor of marijuana emanating from your car) then, you can be further detained, and in the event that the officer has a reasonable and articulable suspicion that drugs are involved then you can be detained until a K-9 arrives (or, as in McNair's case, the cop can take his chances by ordering you out and conducting his own warrantless search). Anyhow, back to the story at hand... So during Deputy Swilley's search of the car he discovered a backpack, which he opened, and inside he found a "Cookie Monster doll" which he proceeded to remove from the backpack.





When Deputy Swilley picked up the doll he reportedly believed it to be heavier than expected.  Closer inspection allegedly revealed "a slit cut into the blue Sesame Street doll", and further probing resulted in the retrieval of 2 baggies with a cumulative weight of 314 grams of cocaine that were hidden inside.  





The Monroe County Sheriff's Department would take to Facebook posting the pic above with the caption "Cocaine Hidden in "Cookie Monster"".





Another Memo to the Folks:  The general 4th Amendment rule is that law enforcement needs a warrant to conduct a search, but there are many exceptions to the "warrant requirement".  The best practice (for the cops) is almost always to get a warrant, and, when they don't, then they run a risk that the fruits of their search will be  both declared "poisonous" and suppressed from introduction into evidence (this is called the "exclusionary rule").  If a vehicle search is conducted and containers are found inside of the vehicle (like, for example, a backpack), again, absent an exception to the warrant requirement, the cops cannot open the container without first obtaining a warrant.  So, if I were McNair's lawyer, then this would be my first area of attack in this case.  You can watch HaberPA's VideoFAQ / YouTube Webisode on "What is the Exclusionary Rule and how can the Cops sidestep it?" by clicking on the video link below or by clicking here...






Memo to Camus Lorenzo McNair (and Drug Dealers / Courriers in general):  Not that I am promoting your endeavors (to the contrary, I encourage you not to deal, traffic or move controlled substances and instead to find a legal and productive niche in society...), but, if you are Hell-bent on moving dope then make sure that you don't get popped for something stupid, like an avoidable traffic infraction.

Married Pastor is Arrested in Prostitution Sting Op after paying an Undercover Deputy Sheriff $80 for Sex ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Pastor Hilburn worked at The Woodlands First Baptist Church in Harris County, Texas.




Pastor Hilburn is a married man (that's his wife, Lisa, below right) with three children...




And now, courtesy of bad judgment and the Harris County Sheriff's Department Pastor Hilburn also has his own mug shot...




On Wednesday, July 19th Pastor Hilburn was arrested in a Police Prostitution Sting after paying an undercover Deputy Sheriff $80.00 for sexual activities.




To the best of my knowledge and belief details of the transaction (such as:  1) whether the undercover officer a man or a woman, 2) whether the sting op was on the street, on the internet or otherwise and 3) precisely what "sexual activities" Pastor Hilburn had contracted for...) are yet to be released.  But, rest assures that...




And I'll bet that Pastor Hilburn's wife is curious too...




A statement from officials at The Woodlands First Baptist Church confirmed that after his arrest Pastor Hilburn had resigned: "In regard to the recent arrest of Dr. Eddie Hilburn, The Woodlands First Baptist Church has received and accepted his resignation and has taken steps to notify the congregation.  This is a difficult time for Eddie, his family and our church. We continue to seek God's will with grace and truth, providing love and support to all those affected, while reaffirming our commitment to the highest expectations for our church and its leadership."  Um yeah...

Dumb Criminal: FL Drug Dealer Calls Cops to Report Theft of his Cocaine and gets Arrested for Possession of Cocaine & Paraphernalia ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




Meet 35 y/o David Blackmon of Fort Walton Beach, FL.  That's his mug shot below...




David is clearly one of...




According to a police report (which you can see below), on Sunday, July 16, 2017 David dialed 911 complaining about a burglary and theft.  When an Okaloosa County Deputy Sheriff  responded David reportedly identified himself as a "drug dealer", telling police that "someone entered his vehicle and stole $50.00 cash and about one-quarter of an ounce of cocaine off the center console."




And if that wasn't dumb enough David then proceeded to show the Deputy where the cash and contraband were prior to having been stolen (on the center console) at which time the Deputy saw "a plastic baggie containing suspected cocaine on the center console".  A further search would result in seizure of a crack rock on the console and a crack pipe, with residue, on the floorboard, all of which reportedly field tested positive for cocaine.  Making matters worse for David, when the Deputy told him that he was under arrest David "refused to follow commands", resulting in an additional charge for resisting arrest without violence.




But the kicker, the coup-de-gras, is that while the Deputy was reading David his Miranda Rights David reportedly asked the Deputy:  "[I]f I knew [that] the cocaine was there, why did I let him keep talking[?]".




David, who is reportedly a convicted felon with drug priors who has served state prion time, now faces both felony and misdemeanor charges for possession of cocaine, possession of drug paraphernalia and resisting arrest without violence (if found guilty of all charges then, in FL, David faces a maximum 7 year sentence), and all because he made a bad call (quite literally).




Memo to the Folks:  If you are engaged in criminal activities then calling the cops is probably not the best idea.  Regardless, and no matter how the police-citizen contact is initiated, if you are being questioned by law enforcement, and if you have anything to hide, then STFU and invoke, or you are sure to become the absolute best witness in the State's case against you.

Woman Lies About having Breast Cancer and is caught after Co-Workers raised $17k to help with Chemo but she showed no Side-Effects ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




Meet 25 y/o Hillary McLellan of Sebago, Maine.  That's her below...




Hillary worked as a bartender at the Depot Street Tap House in Bridgton, Maine...




Apparently she was beloved at work and when she told her co-workers and employer that she had breast cancer everyone was concerned for her health.  




The timeline (reportedly as told by Hillary's boss, Carrye Castleman-Ross):  In October, 2015 Hillary first claimed to have been diagnosed with breast cancer, in February 2016 she claimed to be in remission and in the Summer of 2016 Hillary claimed that her cancer had returned "with a vengeance", having spread to her blood and lymph nodes.  And so, in October, 2016 Hillary's boss and co-workers held a benefit event for her, raising some $17,000 for her cancer-related expenses.  The proceeds, composed of $10,500 in checks and the balance in cash was put into a joint bank account that was set up by Carrye Castleman-Ross.




After that things went south for Hillary, fast.  Why?  Well apparently because Carrye is neither blind nor dumb.  Despite her employee's supposed chemotherapy and radiation cancer treatments Hillary's hair was not falling out and she seemed to be in good health.  So, after a while Carrye picked up the phone and called Hillary's father, who reportedly said that he did not know anything about his daughter's alleged illness, causing Carrye's BS meter to ping right.




Carrye called the cops and at their direction she, together with a few of Hillary's friends, reportedly grilled her about her cancer claims, on camera, until Hillary finally admitted the truth of the matter, allegedly saying "Okay, I don't have cancer", after which the video tape was turned over to the police.




Hillary was Indicted on May 5, 2017 for one count of "Theft by Deception", more specifically being accused of effectively stealing $10,500 from 16 business and individuals from October 2, 2015 - January 27, 2017.   




Hillary's former roommate and colleague at Depot Street Tap House, Molly Bean, reportedly drove Hillary to many of her chemotherapy and radiation appointments, was always told not to come inside, as "She [Hillary] said, 'I don't want you to see me hooked up to machines."' Per Molly:  "I thought she was skipping treatments. Never in a million years did I think she wasn't sick."  




Hillary's friends reportedly think that Hillary did not lie for money; rather they believe that she lied for attention, and possibly that she suffered from mental illness.  Regardless, she no longer works at the Depot Street Tap House and, if she is convicted, then Hillary faces up to 10 years in prison and a $10,000 fine.  




On January 31, 2017 and on it's Facebook page the Depot Street Tap House posted a heartfelt statement acknowledging "that we were being duped by our employee who we all thought has been fighting cancer for over a year. This charismatic, seemingly beloved community member took advantage of our compassion and generosity and maintained the charade until Sunday, when, with the support of local law enforcement, we were able to get a confession from her."




Memo to the Folks:  Being ripped off sucks.  Being ripped off and lied to sucks worse.  But being ripped off and lied to by someone who has the ability to tug on your heartstrings, well that is betrayal and it sucks the worst.  




Memo to Hillary McLellan:  As crazy as it may sound I hope for your sake that there is a mental health explanation for your behavior (I mean one other than your being a complete and utter sociopath), that you are amenable to receiving real treatment and that you can somehow outlive the scarlet letter that is sure to follow you, especially in a small town, for a long long time.
