DWLS / Driving With License Suspended / Driver License Suspended / Suspended Driver License / Suspended License / HTO / Habitual Traffic Offender / AVVO / Michael A. Haber, Esq. **ARRESTED / **305DUI

Q:     I was pulled over and received a ticket for driving with license suspended but cop issued a ticket to another person.   I signed the ticket in my name but was told i didn't have a court date then 2 months later I received a notice to appear. Is this legal ?

Answered At this moment - right now - what happened is irrelevant.

What matters, all that matters - right now - is that you hire a lawyer to deal with your DWLS case (unless you were somehow subpoenaed as a witness and not a Defendant - you should read the document carefully to be sure - it is your case, and not another persons, that we are talking about).

During the course of your consultation you should come to understand what your situation actually is, and how your problem may be approached. Your problem should be diagnosed, foreseeable avenues discussed and hopefully a reasonable litigation objective secured. In short, after your consultation you should know what your problem actually is and how your problem can be approached.

Do not discount the fact that your DWLS can become a significantly bigger problem. In Fl you can be designated a "HTO" (habitual traffic offender) for racking up 3 DWLS convictions. Once "habitualized" you not only earn a five (5) year driver license revocation but your next one (your fourth - 4th) subjects you to felony prosecution and five (5) years in state prison.

My advise: Locate an experienced Ft. White, FL area criminal defense or seasoned traffic defense lawyer, make an appointment, show up on time, bring whatever evidence, documents or witnesses that you may have, engage in a meaningful face-to-face consultation and get yourself some advise which is legally sound and has been custom tailored as possible to meet your specific reasonable needs in your unique case.
