New York Jets' Sheldon Richardson is Arrested after Fleeing from cops at 143 mph in his Bentley ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Meet 24 y/o Sheldon Richardson, 2013 NFL Defensive Rookie of the Year and 2014 Pro Bowler for the York Jets.

On July 2nd, 2015, after the New York Jets had already demoted Sheldon to second string status, he was suspended by the league for four (4) games for violating the NFL's drug policy.  Twelve (12) days later, on July 14th, 2014, Sheldon was arrested in St. Louis, Missouri (that's his mug shot below) for resisting arrest.

Sheldon was arrested after he attempted to flee from cops who were in pursuit of his Bentley for racing another car in while and reaching speeds up to 143 mph.  When police attempted to stop him Sheldon reportedly exited the freeway and parked his Bentley in a nearby driveway.  He was caught because he failed to turn of his brake lights.  Upon approaching the Bentley cops reported detecting "a very strong odor of burnt marijuana" emanating from inside of the vehicle (which also contained while a fully loaded handgun and 12-year-old child).  I suppose that Sheldon could have been more obvious had he tried....

Making matters worse for Sheldon is the fact that he did not, as he was required to do, inform the Jets of his arrest.  The team found out in surprise fashion when Sheldon commented on his twelve (12) days earlier failed drug test, and this lapse (his failure to disclose in a timely fashion) could subject Sheldon to further punishment by the NFL.

Personally I've been a life-long Dolphin's fan so Sheldon is irrelevant to my feeling on the {stinking} Jets...

It's a Miami thing....

Not really.  Pretty much everyone but Jet's fan hate the Jets, even...

Memo to Sheldon Richardson:  In regard to your drug suspension I know that you went on record saying:  "I can say 'no', I just choose not to.  It was a depressing time in my off-season, and that's just that.  It's just that simple "Bro".  There's money on the line.  My money is worth more than some weed."... BUT anyone can SAY it; until you LIVE it they are just words... "bro".   You are 24 and drive a Bentley.  Yeah you are a Jet but whatever... you are still a NFL pro football player, with God-given talent sufficient to have earned you accolades beyond most people's dreams and what do you do?  You squander it.  And that's just plain f'ing pathetic... "Bro".  As Bobby D (playing Lorenzo Anello) said to his son Calogero Anello in "A Bronx Tale":  "The saddest thing in life is wasted talent".  Wake up, grow up and man up... "Bro".

Burglary FAIL! Lake Worth Burglar Stops at Fridge, Eats himself to Sleep & is Awoken by Responding Deputies ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Meet 22 y/o Jacob Miller.  That's his mug shot below....

Jacob is a  hapless thief.  He was found, literally passed out, on a couch by the owners of the house that he had burgled after he had pigged out on beer and chicken wings.  The Lake Worth family told police that they had came home to find chicken bones and empty beer bottles scattered about their kitchen floor, as well as a man asleep in their living room.  And this almost unbelievable story was confirmed by Palm Beach County, Florida Sheriff's Deputies who found precisely that:  22 y/o Jacob Miller still asleep on the couch of the home in quiet suburban Lake Worth, Florida.

After taking Jacob into custody Sheriff's Deputies found numerous items of jewelry on him that belonged to the family.  They also determined that Jacob was a fugitive, as he was wanted in Texas for another burglary.

Memo to Jacob:   Regardless of your chosen skill, trade or craft, if you want to be considered a "professional" then you must demonstrate the levels of knowledge and discipline which are expected and required for your particular field.  You, my friend, are a "failed burglar".  I strongly suggest that you invest the time to learn a new skill set while you are serving your prison term.

NoCar Man Chokes Out Robber who Interrupted his Wedding Proposal ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Nicolas Anderson is an ordinary guy who's proposal was anything but.  Nick had been working on the right way to pop the question to girlfriend Deanna Deal, so Nick and Deanna's son Brighton had come up with Salsarita's Mexican restaurant in Hickory, North Carolina, as the best place to do it.

So there they were at about 6:30 pm on Monday, July 27th, 2015, Nick was all set to propose, Deanna was looking on and then Graham Wilson Kiziah, robber not so extraordinaire (pictured below), entered picture and put Nicks plans on hold.

Per Nick, as he was about to propose "The manager came to the door and locked the door. The guy behind the manager pushed him out of the way and unlocked the door."  Doing the math quickly in his head Nick sprang to action, grabbing the robber around the neck and choking him, putting him out cold within seconds.  Although no one (other than Deanna's son) knew about Nick's interrupted plan, his act of heroism was greeted with applause by other diners, and especially by the restaurant manager (as Salsarita's had been robbed twice in the previous month).

Fortunately Nick had a contingency plan, driving Deanna over to his backup venue, nearby Winkler Park, where Nick proposed to Deanna (who still had no idea what he had planned).  Fortunately Deanna said yes, after which Nick admitted that " after all that happened, asking her to marry me wasn't near as bad."

Will someone who has been arrested for felony trespass first offense go to jail? ~ Chosen as "Best Answer" on AVVO ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

A:     My son has been arrested for trespassing in a construction zone in Fl. This is his first offense. Will he be sent to jail?  He was riding his Enduro motorcycle in a construction zone.  The site had a sign posted but he did not see it. A truck entered the site so he left. He was then detained and arrested for trespassing in a construction zone. He was told that this is a 3rd degree felony. We have little money for a lawyer and I am terrified that he will be sent to jail. What should we do and how likely is it that he will have to serve time? Can we get it dismissed or reduced to a misdemeanor?

Answered Trespass in  a Posted Construction Zone is a 3rd degree felony for which he faces a max of 5 years in prison.  Please see: See F.S. 810.09 - http://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0800-0899/0810/Sections/0810.09.html

If this is his first offense then it is almost certain that he be eligible for a diversionary program. If it is not - or if he is not - then his case will have to be defended, whether by a private or a court appointed lawyer.

Diversion is a program which is designed to make your son think twice about future criminality by way of making him jump through a series of proverbial hoops during a period of supervision, successful completion of which results in a dismissal. The program is owned and operated by the State Attorney's Office and they have absolute and unequivocal discretion as to whether to admit him, keep him or "graduate" him from their program.

Knowing that, the question now is whether or not diversion is right for your son. There may or may not be viable defenses to the charges, affirmative or otherwise, or there may be factual, legal, procedural or substantive mechanisms by which to attack and beat the charges without going through diversion.

The best way for you to get competent advise is going to be to have a face-to-face meeting with a criminal defense lawyer who can follow-up on your information with questions of her/his own, as well as review the police reports and citations and then offer an informed opinion.

Please take a look at my Avvo Legal Guide on diversion in Florida. It contains a great deal of information on the subject and should be helpful to you. For your convenience a link follows:

You can also view my Webisode on Diversion in Florida @https://youtu.be/23JAu2eFhcM

Either way please be sure that charges do not magically disappear. Unless there is either insufficient proof or if the police have exceeded their mandate (and sometimes even then) the only way that charges will go away is with the assistance of a skilled and experienced criminal defense lawyer who tirelessly efforts on your behalf.

I hope that I have been helpful in answering your question.

Underage College Junior Uses Fake ID, Drinks to Excess, Has Wrong Way Highway DUI Crash & Kills 3 (including a 6 y/o kid) ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

A 20-year-old UNC-Chapel Hill junior named Chandler Michael Kania (pictured below) caused a fiery wrong-way collision on I-85 in NoCar in the early morning hours of Sunday, July 19th, 2015 which killed three (3) people (including two (2) adult women and a six (6) y/o girl) and severely injuring two (2) others (one (1) of which was Chandler himself).

After being stabilized at the hospital Chandler was arrested and charged with three (3) counts of second-degree murder, three (3) counts of felony death by motor vehicle one (1) count of felony serious injury by motor vehicle, as well as lesser charges for DWI,careless and reckless driving and possession of alcohol by a person under the age of 21.  On Tuesday, July 28th, 2015 Chandler was released from jail on house arrest and $1,000,000.00 bond .

Per Highway Patrol reports the accident (if you can call it an "accident") occurred as Chandler was drunkenly traveling in the wrong direction on Interstate 85 at around 3:00 am on July 19th and crashed his Jeep Wrangler into a Suzuki which had four (4) occupants.  Passing motorists who witnessed the crash and called 911 recounted how both vehicles became engulfed in a massive fireball.  "There’s a big car accident with a car traveling on the other side of the road. They smashed into each other and it blew up the car," one (1) witness reportedly told a 911 dispatcher.

Killed in the crash were 49 y/o Felicia Harris, 46 y/o Darlene McGee, both of Charlotte, NoCar, and Harris’ 6 y/o old granddaughter Janiece Smith, of Brooklyn, New York (all pictured - in order - below).

In addition Harris' youngest daughter, 9 y/o Jahnia King, suffered serious injuries, as did Chandler himself, who suffered a broken ankle, broken foot and a broken arm in the crash. He was brought into the courtroom for his bond hearing in a wheelchair.

While Chandler's family has said in a statement that their prayers are with the victims and their families, the victims' families apparently don't share the same sentiment. Darlene McGee’s sister, Connie, called Chandler "a selfish young man" for making the fateful decision to drink and drive, stating that "he had his whole life ahead of him, but he chose to drive drunk".

Adding insult to injury (literally) Connie McGee stated that her eldest sister, Harris, and the two girls, aged 6 and 9, were driving home from an annual memorial service in Virginia for McGee's mother when the crash happened.  Apparently the women had in their car an urn containing the ashes of Darlene and Connie’s mother, and the family are now hoping to recover some of the cremains from the charred Suzuki.

A search warrant revealed that Chandler had used a fake ID card indicting that he was of legal drinking age to order alcoholic beverages the night of the crash at two (2) different Chapel Hill hot spots, "La Residence" restaurant and "He's Not Here" bar, both of which are now being investigated for serving a minor.  Further investigation by law enforcement revealed (from one of his roommates... nice huh?) that Chandler had reportedly been going to the hot spots regularly and that he routinely used a driver’s license which belonged to an older Sigma Phi Epsilon fraternity brother. Finally, the creme-de-le-creme is that some of Chandler's "friends" (who had been out with him on the night of the wreck) reportedly told cops that they had tried to prevent Chandler from getting behind the wheel after their alcohol-fueled outing (which had started earlier on Saturday, July 18th evening) but that Chandler physically knocked one (1) of them to the ground and drove off anyhow.

Memo to the Folks:   Wow.  This is truly as bad as it gets.  Chandler graduated from High School in 2013 where he was student body president, played soccer and tennis and swam for his school.  He was reportedly "a rising college junior", being a student body board member with a mentoring program on campus and now he has to live with taking three (3) innocent lives, shattering uncounted others, is locked down with an ankle monitor and faces 65 years in prison.  And all of this is because he made a bad alcohol fueled decision.

When it comes to the subject of drinking and driving, the best advice that you are ever going to hear is:  "Don't do it!  Get a DD (Designated Driver), not a DUI".

Be smart{er than Chandler Michael Kania}: Don't drink and drive, but, if you do, just say "NO{thing}", don't blow (in FL your 2nd subsequent refusal is a crime) and call me stat at 305-381-8686, 305-798-2220 or 1-888-SHARK-8-1.
