Q: Will the cops come to my home and arrest me.? I missed a court date last week and got a notice in the mail that I have a warrant out. It was for driving with a suspended license with knowledge (we thought it had been taken care of but apparently they didn't get the checks we sent). I can't afford bail right now because my husband has been out of work. We can afford it in a few weeks since he just started a new job but I would have to wait until then. I saw that I can get some motions filed but I do not have the money for an attorney to write them up.

Answered . They might send the warrant squad to your house or they might not. But either way you have a warrant, and the bottom line is that warrants suck; that and that oftentimes they end up in incarceration. When it comes to warrants, anyone anywhere who has knowledge of the existence of the warrant has 2 choices: Either they can deal with it proactively, in an offensive manner or they can live day to day, waiting until it is ultimately served, and then play catch-up (defense).
In this light warrants can be likened to cancer. If it exists (whether it is a warrant or cancer) then you have a problem. You can either choose deal with the problem and hope for the best or you can wait for the problem to deal with you in its own natural fashion. In the former event it may or may not work out favorably for you, but, in the case of a warrant, at least the State and the Judge will have to acknowledge that you voluntarily hose to bring the matter to them, an undeniable fact that even an average defense lawyer should be able to use to your advantage during the pendency of your case. In the later event however, as with cancer, the longer that you choose to wait (whether in denial, self-pity or simply lost in hope and prayer that it'll heal itself / go away) then more time that it has to metasticize and destroy you from within.
With even a half way decent explanation many Judges will set aside failure to appear warrants, especially if the subject humbly asks the Court to do so in a timely, responsible and respectful fashion.
My advise, plain and simple, is that you should at least effort to discuss the case with an experienced Clearwater area criminal defense lawyer. Either way, that warrant is a proverbial cancer which will almost surely prejudice you, whether with your family, the Court, the State or both, sometime down the legal pike. Find a way to get it done.
