What happens when the Court Orders a Competence Evaluation? ~ Best Answer on AVVO ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Q:     Please someone help me on a criminal case. The defendants attorney asked the court for complete evaluation of the defendant, it was granted two complete evaluation for mental illness by two different experts. Does that help the defendant ? Will the person most like get out of jail if he has 16 total charges or attempted murder & l&l battery on a child?

Answered No. He was probably evaluated for competence to proceed. If he is found incompetent then he will be transferred to a hospital for treatment and reevaluation within 6 months. If he is found to be competent then the cace will proceed immediately. Either way his case will not be dismissed, at least not unless he is hopelessly incompetent and evaluations all agree in that regard for an uninterrupted period of 5 years.
