FL Lawyer gets Arrested for Aggravated Battery with a Deadly Weapon, Fleeing or Eluding, Resisting Arrest and Reckless Operation of a Vessel ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




Meet Kenneth Carl Wright, an Orlando, FL based lawyer.  That's him below.

 When he's lawyering Ken practices corporate, business and intellectual property law.

But on Sunday, November 6th, 2016 Ken was not lawyering.  Instead he was allegedly busy recklessly operating his boat on Lake Maitland in Winter Park, Florida.

Winter Park Police responded to Lake Maitland in response to a call that Ken was captaining his boat at a high rate of speed and that he had made several turns nearly colliding with another vessel that was occupied by 3 people (and no, that is neither Ken nor his vessel below... it's just a demonstrative tool).

Responding Winter Park Police claim that they tried, to no avail, to get Ken to stop several times.  Winter Park Police Officer Galloway claimed that on the first two of the three times that he tried getting Ken to stop what he got instead was Ken's middle finger, and on the third Ken simply waved at the officer and then drove off.

And so it was that the Maitland Police Department's marine unit was called in.

Maitland Marine Unit Police Officers report that they too tried to stop Ken but that he sped past them, eventually stopping at a dock, debarking and hitting the pavement running.

As he ran a Winter Park Police Officer claims to have yelled several times for Ken to stop, warning that he would be zapped with a Taser if he didn't stop.  But Ken didn't stop, and so he was tasered, rendering his arrest much a simpler task.

In Orange County, FL Criminal Court Case # 2016-CF-014142-A-O, Ken now faces felony charges for Aggravated Battery with a Deadly Weapon (a 2nd degree felony punishable by up to 15 years in prison), Non-Aggravated Fleeing or Eluding Police (a 3rd degree felony punishable by up to 5 years in prison), two counts of Resisting Arrest without Violence (1st degree misdemeanors each punishable by 364 days in jail) and Reckless Operation of a Vessel (also a 1st degree misdemeanor punishable by 364 days in jail).

Memo to Kenneth Carl Wright:  I wasn't there, I don't know what actually happened, and I only know that which I've read and watched on news reports but I do know this: A) Flipping off the cops may be constitutionally protected under the 1st Amendment but it won't ingratiate you with either the cops (as you've now no doubt learned), the prosecution or the court, B) the rest of your alleged behavior is not protected by anything (except maybe your criminal defense lawyer), C) you're not only facing 23 years behind bars but your license to practice law is now in serious jeopardy and D) you present much better in a suit and tie than you do in your mug shot.  

Memo to the Folks:  Believe it or not, lawyers are people too.  We, like everyone else, have the same frailties, weaknesses and lapses of judgment.  I am sure that Ken is neither a bad person nor a bad lawyer; rather I'm guessing that he just had a bad day, and even though none of the stories that I saw mentioned alcohol I'm betting that it was a factor.  Why?  Because...

Mother is Arrested for Child Endangerment when her 23 month old Toddler Drinks Vodka that she Smuggled into High School Football Game in a Sippy-Cup ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1



I found plenty of articles about but no pictures of 30 y/o Andrea Mucciarone, of Ohio. Regardless, Andrea was reportedly arrested for Child Endangerment because her 23 month old toddler son was taken to the ER after drinking vodka that she allegedly had hidden inside a sippy-cup that she took into a high school football game.




The incident occurred on October 28th, 2016 when Andrea allegedly smuggled the vodka into Conneaut High School for a football game.  





At some point during the game the toddler got a hold of, and drank from, the sippy-cup, but it wasn't until after the game had ended that a relative noticed that the child couldn't stand up and figured out that something was wrong.  It didn't take the pros at the ER to figure out that the toddler had ingested alcohol, prompting hospital staff to call the cops and ultimately leading to Andrea's arrest on a 1st degree misdemeanor charge (which, in Ohio, reportedly carries a maximum penalty of 6 months in jail and a $1,000 fine). 





The child has been placed in the custody of a relative and Andrea is now a viable contender for the cover of...

FL Man is Arrested for 2 Counts of Felony Battery on an Emergency Care Provider after Throwing his Glass Eye at Treating Hospital Personnel ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




Meet 54 y/o Edward Dorsey of Largo, FL.   That's him below...





On October 30th,k 2016 Ed was arrested on domestic violence charges for allegedly hitting his wife.  Due to his condition at the time of his arrest (Ed was reportedly pretty hammered on booze and dope) prior to being booked into the Pinellas County Jail Ed was transported to the Largo Medical Center for medical treatment.




Per the police report, while in the emergency room, Ed "removed his glass eye" and then "threw his glass eye at the ER doctor and ER nurse".  
The report indicated that Ed had actually been instructed by medical personnel and other police officers not to remove his eye, yet he decided to ignore the requests, reportedly stating that "I can do whatever I feel like doing" before flinging his fake eye across the room.  Apart from his DV charge Ed was also arrested on 2 counts of felony battery on an emergency medical care provider.

Parenting FAIL! 41 y/o FL Mother is Arrested for 3rd DUI and Child Neglect when her Kids call Cops and Report that their "Drunk Mom" is in the Car ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




Meet 41 y/o Shaun Marie Orlos, mother of 2 and Melbourne, Florida resident.  That's her below....





On Halloween (Monday, October 31st, 2016) eve Shaun picked up her 3rd DUI (and a DWLS for driving on a DUI suspension) when her 12 y/o son and 7 y/o daughter called the Melbourne Police to report that their mom was drunk and sitting in the passenger seat of her car.





And when responding cops arrived at the parking lot located at 1080 North Wickham Road at about 10:30 pm they observed Shaun in the driver's seat with the engine still running.  Melbourne police reported that she "smelled of an alcoholic beverage, had slurred speech and blood-shot eyes" and that "when she exited her vehicle she could not stand without leaning on it. She refused to do field sobriety tests and submit to a breath test and was subsequently arrested."






Apart from picking up her 3rd DUI (within 10 years of - er, withing 2 years actually - of her last, and which is aggravated for having children in the car) and the attendant DWLS, Shaun was also charged with 2 counts of child neglect, putting her in contention for October, 2016's centerfold in...





When it comes to the subject of drinking and driving, the best advice that you are ever going to hear is:  "Don't do it!  Get a DD (Designated Driver), not a DUI".

How do you deal with a Probation Officer / PO who's giving you problems at every turn? ~ Chosen as "Best Answer" on AVVO! ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Q:     How should I try and deal with my probation officer?  I've been on probation for a few months now, and I've been trying to get a state transfer(due to my living situation). I brought it up to my probation officer and he told me that I have to get my community hours done before he can do the paper work. I get that done...then he tells me to make a payment (a certain amount). I get that done...now it's already 2 months later and he still hasn't done anything. Now he wants me to pay another amount before the paper work gets done. He knows my living situation and I feel like he is trying to get me to violate by me not having anywhere to stay. I want to go to his supervisor and file a grievance but I was told that might not be a smart thing to do. I'm pretty much out of choices and I get off of probation in a few months so I don't want to ruin it. What should I do? Thank you!

Answered You are going about it all wrong.

My advise is simple: Stop playing lawyer and hire one.

It's not up to your PO it's up to your Judge.

The issues of probation enforcement, modification, ET and transfer are all 100% discretionary with the Court - that is to say that the Judge is free to say either yes or no without fear of appellate action... it is entirely the Judge's call. Good mood, bad mood, bias, prejudice, sleep, lack of sleep, etc... all of these intangibles can effect the Judge's attitude and ultimate decision.

Thus, the best way for you to hedge your bet and to accomplish your objective is for you to hire yourself a dialed-in criminal defense lawyer who can stitch together a comprehensive and persuasive packet of materials geared toward skewing the ruling in your favor. As with most things in criminal court, your odds are likely to exponentially increase with a skilled and experienced criminal defense lawyer at the helm. You have taken this most reasonable step and now must await your's Judge's ruling.

If you seek intrastate transfer (i.e. to another county in FL) you have the additional burden of either getting the target county to accept the transfer. If this proves to be a problem then you should be prepared to argue for a modification to either administrative (i.e. "call in") probation or non-reporting probation.

If you seek interstate transfer of probation (to another State), the approval process is more complicated. Not only do you need your Judge's permission but you also must meet the criteria for transfer pursuant to the interstate compact on adult offender probation. The interstate compact is an agreement that all 50 States subscribe to and which governs the transfer of probation from State to State. You can access their website at the following URL: http://www.interstatecompact.org/

Thus, even if the FL Judge grants you permission to relocate the "target State" still has to accept your transfer of probation. If they do they you are golden but if they don't then your request for transfer will be denied and you are stuck. In this event your options are as follows: 1) You can try to petition the target State for a waiver vis-a-vis a lawyer in that State; 2) You can petition your FL Judge to early terminate (ET) your probation; 3) You can petition your FL Judge to convert you to "administrative" (i.e. "write-in" or "call-in" non-supervisory) probation; or 4) To stay in FL. You have no other options as I see it.
