Intoxicated OH Man Strips and Defecates on the Self Scanner Counter at a Cincinnati Kroger Grocery Store ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




Meet 23 y/o Colin Murphy, an Account Executive at Asad Wholesale in Cincinnati. That's his mug shot below...




In May, 2016 Colin, reportedly reeking of alcohol and with slurred speech and exhibiting a staggered walk, entered a Cincinnati Kroger Grocery Store.




He then, inexplicably, stripped off his clothes, climbed onto a self-checkout machine and proceeded to defecate on a self checkout machine.




Colin was charged with public indecency and disorderly conduct, posted $2,000.00 in bail and has been ordered to stay away from Kroger.




Memo to Colin Murphy:  Please keep your pants on in public and kindly leave the bunny alone.

Can I sue the court or the judge, personally, or both for lost travel expenses? ~ Chosen as "Best Answer" by Asker on www.AVVO.com ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Q:    Is it possible to sue the court or the judge, personally, or both for lost travel expenses? I was summoned to appear in court for Violation of Probation in April. Apparently, unknown to me, one of the stipulations of probation was to get a drivers license reinstated. As I explained to the judge at the hearing, I have been unsuccessful with the DMV in the endeavor to get the drivers license reinstated, or to even get a limited or restricted license. The judge set another hearing date in 5 weeks. Unfortunately, I also had made arrangements for a trip several months prior and had already bought flight tickets and made hotel reservations. The trip conflicted with the hearing date. Using their procedures, I made requests to the Clerk of the Court 6 times to have the hearing rescheduled. The judge refused each time, without good reason I might add. I don't see what the hearing will accomplish, it is next to nothing in importance due to the fact that I must await word from the DMV. The airline will not refund the ticket and I will have to pay for first night hotel stay. I will cost me about a thousand dollars.

Answered 1) You are on probation. You have limited rights. You had better get used to understanding your reality or the Judge can (and probably will) revoke your probation and let you serve your sentence in jail / prison instead. (Being on probation is an alternative to incarceration. It is a gift of sorts, albeit it is given by an Indian giver who can take it back at any time (the alternative being jail). It behooves you to remember that at all times while serving your probationary period. It may help to think of your time on probation as walking on a tightrope. Stray just a little to either side, lose your concentration or balance even for a moment and you fall. However, instead of landing on the ground you land in jail or prison.)

2) The Judge doesn't need a reason, much less "a good one" to refuse your request. You serve at the Judge's pleasure, not s/he at yours. (Again, being on probation is an alternative to incarceration. 3) Your thousand dollars means nothing to anyone but you, and it should pale in comparison to your liberty (which, in my opinion, and based upon your words in your proffer, is in serous jeopardy as you apparently do not have a clue what being on probation means...).

5) My advise:

A) Hire a lawyer to represent you at your PVH. Do not go this alone. Naturally you are free to reject my sage advise and do what you want but I urge you not to represent yourself. There is a solid reason for Abe Lincoln's age old quote that "he who represents himself has a fool for a client". Please do not be that fool. My advise is firm: Hire a lawyer.

B) Wake up, smarten up and get with the program. You are on probation. This is not a vacation. Your next stop is jail / prison.

6) As to suing the court or the judge, personally, or both for lost travel expenses... Last I checked this was still America, and in America you can sue pretty much anyone for pretty much anything. Whether or not a) you can find a lawyer to sign her / his name to the paperwork, b) your lawsuit survives a motion for summary judgment / to dismiss, c) you get a favorable judgment, d) your defendant is collectible or e) you ever see a dime is both beyond my ability to predict and is anyone's guess. That said, suing either a law enforcement officer, agency or municipality is both a civil rights question and almost always an uphill battle. You need to have a viable claim, provable damages and, most importantly, a lawyer who is willing to sign her / his name to your paper containing your factual proffer. Still, this is not a criminal defense question; It is a civil rights question, and, if you want to increase your odds at getting a competent answer then you should repost this part of your question and list "civil rights" and not "criminal defense" as a practice area.

Gates Candy Store of Brooklyn is Busted for Operating a Heroin and Cocaine Trafficking Business from Secret Back Room ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




The Gates Candy & Grocery Store in Bushwick, Brooklyn, New York, sells "cold soda, ice cream, coffee, electronics, newspapers and cigarettes" to the general public.




But apparently they also sell heroin and cocaine to the not-so-general public, or at least they did up until Thursday, June 23rd, 2016, when a routine inspection of untaxed cigarettes by a New York Department of Finance inspector resulted in a top to, a warrant being secured and then a raid by the NYPD, which reportedly uncovered a major narcotics operation which trafficked in heroin and fentanyl from behind a secret back door inside of the store.




A NYPD "narcotics team" helped serve the search warrant at 9:30 am and they found what has been described as an "old school supply business".   




More than a million glassine envelopes, which are typically used to package heroin, were stuffed into 50 boxes, along with "several ziplock bags of suspected heroin" two (2) full barrels of a cutting agent, and several blue bags of what police believe to be fentanyl, which is a powerful prescription painkiller that is often used to cut and enhance heroin.  The NYPD carted out the narcotics and paraphernalia...




and loaded it all into a truck, hauling it to the lab for testing.




Two men were arrested on scene, 46 y/o Mohamad Ali of Hell's Kitchen and 33 y/o Hamdan Alsaidi of New Gardens, both of whom were charged with narcotics trafficking, drug possession and unlawful use of paraphernalia (there is no word on the status of the un-taxed cigarettes...).




Memo to Mohamad Ali and Hamdan Alsaidi:  Props on your entrepreneurial spirit, but... Heroin and Fentanyl don't mix as well with candy as, say, would marijuana. Time to revisit your business plan, as well as your location (Colorado or California would be a better location).

FL Parents are Arrested when their 23 Month Old Son Dies from an Overdose after Eating one of their Morphine Pills ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1



Meet 34 y/o Thomas Marvin Howard and 34 y/o and Christian Lachelle Morgan.  That's the lovely couple below...





These two genii were arrested after their 23 month old son (pictured below) found a morphine pill that one of them had dropped on the floor, ate it and died.




According to police one of the parents admitted to buying two (2) five milligram (5 mg) morphine pills from a coworker, with plans for each of them to enjoy a pill, but at some point one of the pills was lost.  When they failed to find the missing pill they simply, and reportedly admitted that they began to consume beer, smoke marijuana, and share the remaining morphine pill.





In the morning the father left for work, believing his bride and son to be asleep, but when mom woke up she found the child dead and called 911. Toxicologists reportedly found morphine in the child's system, the parents were arrested and DCF promptly took custody of the couple's remaining two (2) children.

Man who Impersonated a Cop and Dressed his Dog as a Police K-9 is Arrested for Trying to Burglarize a Real Cops Home ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




Meet 36 y/o Anthony Ottaviano.  That's him below, wearing a shirt that says "K-9 Handler", purportedly holding himself out to be a law enforcement K-9 handler.





Additional evidence of his poor impersonation come from his dog, whom Tony had also outfitted to appear to be a police K-9...





His car, a White Chevrolet Impala that had strobe lights built in to the dashboard and roof, as well as specialty decals indicating it was a K-9 unit vehicle.






And the creme-de-la-creme was the plethora of law enforcement paraphernalia which was discovered inside of Tony's would-be undercover police car...





This genius drove right into the driveway of the home of real world Palm Bay, Florida Police Officers with his lights flashing, got out of his vehicle donning his "Handler" shirt, with his dog, which was wearing a tactical style vest and leash and walked right past two marked Palm Bay police cars to get to the front door. 





They officers inside of the home looked outside, saw a guy dressed in police tactical gear and who had a canine with him.  The officers inside were torn as to whether they were ignoring a real officer or staving off a phony so they called 911.  In the interim they asked Tony who he was and why he was there, only to be told that Tony was "with Homeland Security".  





Real world cops showed up promptly, detaining and Identifying Tony who, in fact, has nothing to do with Homeland Security and instead is a licensed paramedic with Sunstar Paramedics in Pinellas County, Florida (who has since been suspended from work).  Not withstanding his appearance Tony did not have any weapons on him, and he was arrested for attempted burglary and for impersonating a police officer during the commission of a felony.





Memo to Anthony Ottaviano:   There is nothing wrong with wanting to be a cop.  I get it.  It's a childhood fantasy that some folks are privileged enough to live out and others simply get to imagine.  But sane folk limit their fantasies to imagination, and "smart criminals" think through and plan out their crimes beforehand.  Wtf were you thinking when you rolled up on that house?  Didn't the marked squad cars give you any pause?  Any cause for concern?  Please do not expect a MENSA card to arrive any time soon in the mail, although you might get yourself one of these....
