Q:     Battery arrest 8 yrs ago, will it effect my chances of landing a job?  I was recently contacted by a reputable company for a job position, I will possibly be doing sales in ac equipment. I was arrested 8 yrs ago for battery, I have a record from about 99-05 a few fights and probation violation. No drugs or theft etc. Do I have any chance of landing this job. I have been in 0 trouble for 9 yrs, have and own my own home have a family etc.

Answered Your question is not a law question related to criminal defense. It is an employment question which does not require a lawyer, rather it requires some common sense.

Florida is an "at will" employment state, meaning that you can be hired, not hired or fired for any reason or for no reason whatsoever, provided that there is not an unlawful / protected reason for the hiring, not hiring or firing (like being based upon race or religion).

The decision of whether or not to hire you (or to retain you after bring hired) is entirely up to the employer. If they choose not to hire you because of your arrest history that is their prerogative and you have no recourse.

The fact is that some percentage of potential employers will not hire you just because of your prior arrests while may be more sympathetic. I strongly suggest that you be open and honest and straight forward on your job applications. Explain what you have done in the past, that you are not "that guy" anymore and how you have changed for the better.

Good luck.
