Drunk Man Tasered by Cops & Arrested after being Caught Peeing on Waitress from Key West Nightclub Balcony ~ Call Michael A. Haber, Esq. @ **ARRESTED or **305DUI

The amazingly stupid things that drunk folks do...





Meet Orion Jones, aged 20.  Yes, that's him below....



Orion is not old enough to drink, and he definitely can't handle his liquor, yet drunk he somehow became in the early morning hours of Saturday, January 24th, 2015 when he was observed on the upstairs balcony of Rick's Bar in Key West Florida, peeing...




Unfortunately, beneath Orion's belt (did you like that?) was 26 y/o Tia Cruz, pictured below...




Tia was an unsuspecting and hard-working waitress who had the misfortune of being in the wrong spot at the wrong time.  As she was speaking with a customer she "began feeling something wet on her body" and thought that it might be raining.  Shockingly, at that moment a co-worker yelled out to her that she was being peed on by a guy from the balcony above, and shortly after that all hell broke loose.




After being spotted and called out Orion took to flight.  He was initially restrained by bar bouncers but he managed to shake loose.  Then cops got a hold of him and he once again proved too slippery... perhaps due to some residual yellow liquid lube?




Key West cops finally had enough of Orion's shenanigans and tased him twice, thus ending the melee and permitting an arrest for disorderly intoxication, underage drinking and resisting arrest.  (Why he was not charged with some form of battery, or aggravated battery even, for urinating on an unsuspecting human victim is beyond me, but I am sure that even if the cops didn't think about tacking on that no brainer of a charge then the Monroe County State Attorney's Office will... after all golden showers are not everyday occurrences, not in public anyhow).

If you Plan on Begging the Court for Leniency then it's a Good Idea NOT to Lie to the Judge. ~ Call Michael A. Haber, Esq. @ **ARRESTED





Meet Jeffrey Klein of Jackson, Michigan.   That's him below, all 625 lbs of him, with his family....



After a dispute with the Cedar Spring Mobile Estates on August 25th, 2012, Jeff called in a bomb threat - dialing 911 and stating that a bomb was set to go off at the mobile park - and even though police determined the call to have been a false threat Jeffrey was arrested for misuse of emergency services.




Since then Jeffrey had managed NOT to appear in Court.  For more than two (2) years he had been claiming that he was bed-bound due to weight related health complications, that he was a virtual prisoner in his own home and that he was physically unable to get himself to court... and the Judge bought it, hook, line and sinker, allowing Jeffrey some serious slack until New Year's Day 2015, when Jeffrey was pulled over and arrested for driving his car on a suspended license.  Since then Jeffrey has appeared in Court, only his appearances have been via a live video feed from the jail...




The shameful thing (apart from Jerry lying about the bomb and then to the Judge about his bogus claimed medical inability to leave his home) is that the Judge had agreed in December, 2014 to take Jeffrey's plea in his physical absence and via the internet, and that the Judge was actually considering permitting a home-based sanction.  Naturally when the Judge learned that Jeffrey had been caught outside of his home driving a car (without a license, adding insult to injury), that preferential treatment went way south way fast.




Jeffrey sat in jail from January 1st until his sentencing on January 23rd, 2015 when his fate was determined and set at a minimum term of eighteen (18) months in state prison.  He begged and pleaded with the Court for leniency but this time the Judge wasn't buying Jeffrey's plea.  Apart from being caught in a two and a half (2.5) year long series of lies, the Judge also considered the fact that the 44 y/o had amassed, above and beyond his physical girth, some fourteen (14) prior felony and thirteen (13) prior misdemeanor convictions.  So, hi ho hi ho, it's off prison that Jeffrey goes...




The silver lining, if there is one, is that Jeffrey is reported to have lost 65 pounds, weighing in at 560, since his New Year's Day arrest, and that he can expect to lose more weight as he serves his time. According to a spokesman for the Michigan Department of Corrections severely obese inmates tend to lose weight in prison.  Some "come in here heavy and they've left us much healthier because they are under a specialized medical and dietary plan."  Prison dietitians work with obese inmates to ensure that they consume enough calories.  Jeffrey won't get "special" food but he also won't have access to quantities of unhealthy food.



Memo to the Folks:  Judge's usually enjoy wide discretion in rulings, especially when it comes to sentencing.   They also tend to have long memories.  Think about that, and remember to govern yourselves accordingly.

Q:     I was falsely arrested for domestic battery and my roommates can testify that they heard me say "stop hitting me".  Can I sue?  There was a heated argument when my ex started swinging at me. I escorted her out the door. She went to the police two days later and I was arrested a day after that. The police report mentions a roommate who witnessed everything but who was never questioned. I have a criminal defense lawyer but he doesn't do personal injury cases. Could I get a restraining order? Could I file a report on her for battery? Could I sue for violation of due process or for personal injury?

Answered You listed your non-criminal defense question in a criminal defense forum and are therefore essentially asking criminal defense lawyers who you have not hired to give you advise that you apparently do not wish to seek from your own lawyer whom you have retained.

I suggest that you re-list your question in the proper practice area (which is NOT criminal defense) and that you remove all of the tags that you attached (which will all serve to direct your question toward criminal defense lawyers).

That said I will point out that this is America, and in the US of A you can pretty much sue anyone for pretty much anything.  But, be absolutely clear that every action has reactions, and from your proffer, and as a veteran criminal defense lawyer of 23+ years who has represented many a domestic violence defendant, I think that you would be well advised to DO NOTHING (caps intentional) without first talking to your criminal defense lawyer and securing her / his blessing to take any civil or other action.

Further, if you were my client then be assured that I would severely scold you for posting anything about your case on the internet. That is my office policy, and it is both a blanket and a good policy.  While I cannot effect what you dis or what has happened before I got involved with a case I can do so once I'm on board, and I can certainly instruct my client's as a condition of my representation, not to engage in counter-productive behavior. But that's me and my policy and may or may not apply to either your your lawyer or to your case.

Still, as you asked I will say that If I were you I'd get offline, period, and focus on the prize - which is not going to jail and not having a criminal record.  Believe me when I tell you that many a factually innocent DV Defendant has gotten double screwed by the system (which is clearly skewed in favor of the complaining witness).

Thank about that and then act in your own interests accordingly.

At "Shooters" (not "Hooters") in Rifle, CO Waitresses Have 3 Proverbial Arms & are Literally Well-Armed ~ Call Michael A. Haber, Esq. @ **ARRESTED




Meet 28 y/o Lauren Boebert (that's her below), the owner of Shooters Grill in aptly named Rifle, Colorado, a small town on the western slopes of the Rockies.  





Shooters is an "American Family Style Restaurant" which serves a variety of food...











By both a proverbial three (3) armed, and a literal well-armed, staff...




Unlike such arguably unpatriotic (and unsafe) places as Starbucks and Target, at Shooters the staff openly carry firearms on their waists and the customers are welcomed to do so as well, so long as the customers abide by the sign on Shooters' front door, which reads: "Please keep all weapons holstered unless need arises.  In such case judicious marksmanship is appreciated."




Owner Lauren Boebert, a former "Miss Junior Colorado" and born-again Christian says that Shooters is "a way of life.  When you walk into Shooters you are walking into America.  This is what America is."   When asked about gun violence in the face of such atrocities as Columbine (which occurred to too far away) Lauren says: "I don't advocate violence, but if someone comes after me they need to know what they're up against."  Lauren's vision includes such ideas as the "Guac 9" and "Swiss & Wesson Burger", which happens to be the personal favorite of Rifle Police Chief John Dyer.  In response to questions about his feeling on Shooter's open carry policy the Chief says:  Guns are part of the fabric of the community... I know the waitresses have undergone training, and we've never had any complaints.



Lauren also dreamed up the "Sidearm Sandwich Special", is a $75.00 "package deal" which includes dinner and a State approved concealed weapons class.




Naturally the NRA like Shooters, officially describing it as a place that "serves up some mighty good cooking seasoned with a touch of the 2nd Amendment".

(In Florida it is unlawful to either "discharge" or to "have a firearm readily accessible for immediate discharge" while under the influence of either alcohol - see Florida Statute 790.151 - or controlled substances.)
