Rape / Sexual Battery / Threat / Confessions / Computer / 1st Amendment / Michael A. Haber, Esq. **ARRESTED / **305DUI

Q:   Can I go to jail for threatening to rape an AI bot?  I went to a website called Cleverbot.com (a supposed human like bot), and said "I'm going to rape you." It responded by saying it's going to report me.


A:  First, we don;t have a crime called "rape" anymore in FL; it is called "sexual battery". 

Second, you cannot sexually batter (or rape) a computer.

Third, unless you want to have a nasty run in with the law then I suggest that you control, and redirect, your aggressive thoughts. Unless you are an actor (an actual SAG card carrying member who is working a role) or are engaged in some CONSENSUAL (caps intentional) deviant role playing behavior with your ADULT (again, caps intentional) sexual partner, then I have a difficult time imagining a legitimate reason as to why you (or anyone) would say what you said, whether to a machine or otherwise.

Finally, just because you have a 1st Amendment right to speak does not mean that you should say every idiotic thing that pops into your mind, much less compound the foolish act by essentially confessing to doing the same when you subsequently admit to it by posting your admission online after the fact.

Acts like these (the recorded message followed by the digital confession) lead me to advise that you practice your anger and impulse control skills. Unless you exercise better control you will wind up in hot water somewhere, somehow and sometime.
