Q:     Jail furlough. My husband is currently in county jail in Pinellas County, Florida serving a sentence....his release date is June 18th....I am pregnant and high risk and I am going to have my baby on May 10th....I was wondering if the judge would allow my husband to do a furlough for 2 days so he can be there in the delivery room with me.

Answered Judges are capable of compassion and understanding, but (big but) there is a well-known judicial prejudice against furloughs.

This will be a 100% discretionary and unreviewable call so, if you're gonna make it, then I suggest that you get the best, most "dialed-in", campaign contributing, "State Attorney friendly" criminal defense lawyer that you can find to prepare and argue a most persuasive motion.

While that will (for better or worse, for good or bad) exponentially increase your odds at success, sadly, even then I wouldn't count on the motion being granted.
