"You can't arrest me. I'm the Cake Boss!" - Um, yeah, right. See you at Central Booking Cup Cake! / Michael A. Haber, Esq. **ARRESTED / **305DUI




Buddy Valastro, a/k/a TLC's "Cake Boss", was arrested for DUI in NYC yesterday.  That's him below (although I don't suspect that he looked quite so, "glam" and on top of the world in his booking photo, that and personally, I could never pick him out of his own line-up...):


Anyhow, NYC cops claim that they stopped 'ole Cup Cake (whatever he may be, "Buddy" 'aint "The Boss") for erratically driving his 2014 Yellow Corvette (a nice blend-in vehicle)...


That is the "The Black Knight" below.  He is kicking King Arthur because he is "invincible".  Of course anyone who has seen "Monty Python and the Holy Grail" knows that the Black Knight is not invincible, and in fact, as his nemesis so aptly pointed out, he is nothing more than "a loony".   And, apparently, so too is Buddy.



Cops claim that when they stopped him Buddy exhibited telltale signs of impairment (the ones you read in each and every DUI arrest report, flushed face, bloodshot & watery eyes, odor of alcohol) and that he was unsteady on his feet, but it is what he said and did afterward that will, if anything, most likely bury him.


Buddy reportedly told cops: "You can't arrest me.  I'm the Cake Boss!" - a statement which A) was patently untrue (as they could, and did, arrest him) and B) is certain to be introduced into evidence against him as proof of guilt / impairment / and possibly insanity.  Even if his statement was not ludicrous, it is almost never a good idea to make statements to law enforcement.  It is a rare "subject" that talks her/himself out of an arrest and who's statements do not boomerang back at them with extreme prejudice.  Buddy make bake like the Devil, but he apparently didn't pay attention during Goodfellas, specifically to Lesson #1 ("keep your mouth shut").


Then, to make matters worse, Buddy blew into the breathalyzer, providing the government with tangible proof of his impairment (and, were it in FL - I have no clue as to the law in NY - a rebuttable presumption of his being legally impaired).


Memo to Buddy (and lesson for the Folks):  When it comes to cops and courts, LAWYER UP!


Again, please, pretty please...


And when it comes to the subject of drinking and driving, the best advice that you are ever going to hear is:  "Don't do it!  Get a DD (Designated Driver), not a DUI".

Be smart{er than the Cake Boss}: Don't drink and drive, but, if you do, just say "NO{thing}", don't blow (in FL your 2nd subsequent refusal is a crime) and call me stat at 305-381-8686, 305-798-2220, **ARRESTED, **305DUI, **MIAMIDUI, **MIAMILAW or **HABERLAW.
