Can Someone Press Charges against me without any Evidence? ~ Best Answer on AVVO ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Q:     If someone presses charges on me without evidence can I go to jail?  My dad told the cops that I hit him but I didn't and there is no evidence and I was placed on bond and I got out today.

Answered I hate to be the bearer of bad news but there is evidence. It is called "testimonial evidence" and it is your father's word that you hit him. You are free to dispute that (or not - you are not required to either prove or to disprove anything) or to argue reasonable doubt, but in either event that State can (and likely will) proceed against you, even if merely upon the word of the alleged victim.

Get a lawyer and be very careful while you are on bond. If you get accused of anything else during this time period then they can revoke your bond and hold you in custody until your trial (which could be a while).
