How do I Beat my Charge without Probation of any Kind? ~ Best Answer on AVVO ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Q:     Can I beat this charge without probation?  I was arrested for uttering forge instrument in a very low amount of $250 i have been arrested before for unrelated charges but i have a clean record, never have been convicted. I would like to beat this case without any probation of any kind. What are my options?

Answered You won't know your options from asking defense attorney's online. You will only know your options when you (or better yet, your defense attorney) asks the State Attorney. Defense lawyers do not put pleas on the table. In a perfect world we could, but the world is imperfect and we can't. Instead we ask, and then we negotiate, and sometimes we beg and grovel, and when all else fails (assuming there is no substantive, procedural, legal or factual mechanism by which to effectively beat the case) and trial is not an option, then we prepare a mitigation package and plea directly to the Court.

I have no idea what your priors are (apparently you have some and therefore do not have a clean record - unless I am misreading your question you must have prior arrests) at least, if not PTI completion or withholds) but given the low dollar amount perhaps it is possible to structure a conditional dismissal or some sort; perhaps there is a defense.... I don't know, and that's kind of the point.

You should locate an experienced Bradenton criminal defense lawyer, make an appointment, show up on time, bring your police report for this recent arrest (together with whatever relevant materials or evidence or witnesses that you may have) and discuss the facts and circumstances of the same, as well as candidly disclosing your past (everything about your past as the State will most likely know everything anyhow) and then you will be in a position to get some sort of competent idea of what you may reasonably be looking at. Shy of that you are asking me (us) to pull out our crystal balls and divine answers, and that won't help anyone.
