What happens if I get Arrested while in Diversion? ~ Best Answer on AVVO ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Q:     Pretrial intervention problem.  If I have been ordered for a pretrial intervention in Florida for a grand theft 3rd degree charge, the order was granted in August.  I was arrested for the same charge for another incident last week.  How will that effect my pretrial intervention?   This all happened in FL.

Answered First, you cannot be "Ordered" into PTD. Diversion is a program which is designed to make you think twice about future criminality by way of making you jump through a series of proverbial hoops during a period of supervision, successful completion of which results in a dismissal. The program is owned and operated by the State Attorney's Office and they have absolute and unequivocal discretion as to whether to admit you, keep you or "graduate" you from their program.

Second, if you got arrested on a new charge while enrolled in PTD (and most especially for the same offense - not that it matters though) you will 100% guaranteed be bounced-out of PTD and gave to face your initial charge, as well as having to defend you new one. You can also plan on the State (or the Court sua sponte) moving to rescind your initial bond and having you held in custody without a bond until your trial dates.

You are in a bad position my friend. I strongly suggest that you get into a Tampa area experienced criminal defense lawyers office before a lawyer has to go visit you in the Hillsborough County Detention Center.
