Can I Plea to Sale but not to Possession Charges? ~ Best Answer on AVVO ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Q:     Can you take some charges to trial and plea out on others in the same case?  I have been charged with possession charges and sales. I want to plea out to sale charges but take the possession charges to trial. I was not in possession of anything so I do not want to plea out to those, but will not take the sale charges to trial. what are my options? do I have to open plea to the sale charges?

Answered You'd better talk to your lawyer long and hard before you start splitting your hand. There are extremely serious consequences for admitting to anything, even if, especially if, you plan on denying other inextricably intertwined components. Even if your question were less consequential, much less as is, only someone with a firm grasp of the facts, circumstances and intricacies of your case and yourself can give you prudent advise. Sit down and talk with your lawyer, face to face. If you don't have one, get one. You cannot have an intelligent discussion about your case on line and you cannot get an informed opinion without first having the discussion. That said, and just some food for thought, how is it that you could manage to sell something (which you presumably will admit by virtue of a plea) that you did not possess?
