Woman seeking a Tactical Advantage in Child Custody Case WireTaps Diaper Bag to get Dirt on Daddy gets Arrested instead ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




Meet 37 y/o Teri Smith of Salt Lake City, Utah.  That's her mug shot below...




Apart from looking like a failed actress seeking a role as the Wicked Witch of the West this maniacal mother was arrested for electronic eavesdropping after being caught putting a microphone device on her children's diaper bag on nine (9) separate occasions so as to listen to what their father was telling the children during visitation. 




Although the incident leading to Teri's arrest (on three (3) counts of wiretapping or intercepting electronic communication for trying to pick up conversations between her ex-husband and two children) occurred in 2012 the case is ongoing.  Teri claims a privilege as she was protecting her children from sexual abuse but Utah prosecutors disagree saying that there was no sexual abuse taking place, rather that Teri filed for divorce from the children's father in 2011 and that they have since been engaged in a lengthy custody battle in which Teri was merely seeking a tactical advantage.




Teri was so diabolical in her effort that after her husband discovered the recorder and confronted her about it she switched tactics by placing another recording device in one of the children's coat pockets several days later.  The wiretapping charges are third-degree felonies, which carry possible jail time of five years or a fine of up to $5,000 (just as they are in Florida).  




Memo to the Folks:  Way back in the days when I was in law school (having to walk three miles in each direction uphill - both ways - without shoes in the snow, before electricity - well before the internet anyhow...) I seriously believed the being a criminal defense lawyer was about the lowest, dirtiest, filthiest thing that one could do with a law degree, but then I discovered family law, opening my mind to a much lower level of depravity than I had ever imagined.  What divorcing people will do to one another, how they will use and abuse their own children, is so f'ing disgusting to me that I cannot begin to describe my feelings on the subject.  I know what I am speaking of as I put in several early years in the family law trenches, vowing never again to swim in those waters, but, to this day, I find myself dragged into that under-world in the form of defending domestic violence allegations in both criminal and civil areas (civil in the form of domestic violence restraining orders).  Now please do not misunderstand, I recognize that many of these allegations are true, but many are not.  It happens all too often that the complaining party has fabricated a literal "he said / she said" allegation of domestic abuse to gain a tactical advantage in a divorce or custody case, or so as to gain the exclusive us and occupancy of joint property or simply so as to have a physical tool which can be leveraged any time based upon another BS allegation.  


Props to the Salt Lake City DA for calling this bitch out on her Shenanigans and for prosecuting her sorry ass.
