Meet 19 y/o Silverio Alaniz. That's his mug shot below...
At approximately 6:45 pm on Wednesday, July 15th, 2015 Silverio, wonderful citizen that he apparently is, struck a bicyclist with his car, causing the bike rider to be lodged into his windshield.
Instead of stopping after 54 y/o Jimmie Sines (a local handyman who reportedly rode his bike everywhere and who is pictured below) went through his windshield, Silverio chose to drive another 1/2 mile until he found a suitable alley where he could dislodge the dying man's body, dump it, leave it for dead and take off as if nothing had happened.
Fortunately witnesses saw the bicyclist get hit and then called 911 to report that a man was sticking out of a windshield of a car, permitting cops to locate both the driver and victim; unfortunately the victim, who had been transported to a hospital, was pronounced dead shortly after arrival. Silverio was found and arrested at his mother's house, about (2) two miles away from the alley where his victim was discovered. Upon questioning the teenager reportedly admitted to striking the bicyclist. While neither drugs nor alcohol are suspected to have contributed to the incident, based upon the amount of damage that the bicycle sustained Dallas Police believe that Silverio was driving fairly at the time that he struck the victim. Silverio is charged with "causing an accident involving death". I don't know about Texas but in in Florida he would be facing LSA-Death (we call it leaving the scene of an accident causing death) - a first degree felony punishable by a mandatory twenty-one (21) month prison term and up to thirty (30) years, and he would face additional felony charges for tampering.
Memo to Silverio (and to the Folks): Accidents happen, but the thing that defines an accident is the unplanned and spontaneous nature of the occurrence. If you have an accident with your car then the law requires that you stay on the scene. Why? Well, for one thing, so that the parties involved can all be identified and such that the surrounding facts and circumstances can be readily examined. Putting it as simply as is possible: If you leave the scene of an automobile accident then you commit a crime independent of the accident itself. What Silverio did in fleeing was bad, but in dumping the body at a secondary crime scene so as to seemingly effectuate his escape, well that's just adding insult to injury. I suspect that, like Lucy, Silverio's gonna have some 'splainin to do.
