FL "Road Rage" Incident Leads to a 2nd Degree Murder Charge & 3 Counts of Aggravated Assault with a Firearm ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




Meet 51 y/o Robert Doyle of Beverly Hills... no not in posh CA but in redneck Citrus County, FL.  That's his mug shot below...




At about 10:00 pm on Thursday, July 23rd, 2015 44 y/o Condelario Gonzalez was shot and killed by Bobby D - no, not THE Bobby D....




our Bobby D (the "D" standing for "Doyle", or "Douche" if you prefer... but I digress). Anyhow, per reports, "C-Gonz" was driving along with his family (his wife, his eight (8) y/o daughter and his seven (7) y/o grandson) when Bobby D blew past in a vehicle with a trailer and "driving aggressively".  C-Gonz foolishly decided to pursue Bobby D and as he did his wife dialed 911 from the car stating: "He's just driving like an idiot.  Somebody needs to smack the crap out of this idiot."  In the interim Bobby-D, realizing that he was being pursued also dialed 911 stating:  "Some maniac... is trying to run me off the road.  My gun's already out, its cocked and locked."  Both of the 911 calls can be heard here.




So, dumb as his decision to play pursuing traffic law enforcer proved to have been, C-Gonz nonetheless followed Bobby D to Bobby D's home where he, C-Gonz, exited his vehicle and stated to Bobby D: "I got your number buddy."  Bobby D approached C-Gonz, gun drawn, and, per police reports, was heard threatening to "shoot the victim in the head" before his wife (Bobby D's wife) says several times to "put the gun away" and "don't shoot".  Further, a third party witness told police that C-Gonz was "backing away" from Bobby D when he was shot once, then a second time, and then three (3) more times for a total of five (5) fatal bullet wounds.  C-Gonz is pictured below in a collage from a GoFundMe page which was set up after his death.




Although Bobby D adamantly denied even seeing, much less coming into contact with, anyone who was inside of C-Gonz's car, after investigating the totality of the facts and circumstances surrounding the shooting Sheriff's Deputies disagree, believing that Bobby D not only saw C-Gonz's family but that he had in fact forced the family out of the car with his gun drawn and that he then kept it pointed it at them until the police arrived on scene.  




For his raging psychotic behavior Bobby D was charged with second-degree murder and three (3) counts of aggravated assault with a deadly weapon.  He is being held at the Citrus County Detention Facility without bond and Citrus Sheriff's Captain David DeCarlo has gone on record stating that this incident is not being considered as a "Stand Your Ground" case.




The reason that Bobby D is charged with 2nd degree murder and not 1st is that the shooting, while completely douchebaggerous and utterly unjustifiable, was also not a "premeditated" event.  Where a killing is not thought out in advance and is instead committed in "the heat of passion" it is properly charged as a 2nd (not as a 1st) degree murder. In FL 2nd degree murder is a 1st degree felony which is punishable by up to thirty (30) years in state prison.  The aggravated assaults with a firearm are each third degree felonies punishable by up to five (5) years each (please see Michael A. Moreover, due to Florida's 10-20-LIFE Law Bobby D also faces a minimum-mandatory twenty-five (25) years to LIFE in prison for striking C-Gonz with a (much less multiple) bullet as well as three (3) separate minimum-mandatory three (3) year terms of imprisonment for the aggravated assault with a deadly weapon (firearm) charges (the 10-20-LIFE law has an exception for this charge reducing the "min-mand" from ten (10) to three (3) years per count).

Road rage.  Mellow the Hell out people.  Call the cops and report it if you must but otherwise it's just not worth it to get any more involved.
