Whoa Nelly: Drunk Cowboy Decides to leave his Truck and Horse Trailer at a Daiquiri Bar and instead to "Drive" his Horse Home ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




Jake Williams stopped for a few drinks after work on Tuesday, September 15th, 2015, parking his truck and horse trailer by Coconut Willy's Daiquiris in Watson, Louisiana.




Realizing that he was too intoxicated to drive home Jake decided to jump on the back of his horse (named "Sugar") and head home along side of the highway.  It didn't take long for Deputies to arrive, pulling Jake to the side of Highway 16 and telling him to dismount.  




Officers considered arresting Williams for DUI but realized that they could not as there is a distinction between being at the reins of a horse versus being behind the wheel of a motor vehicle.  So, instead, Jake received a ticket for being drunk in public.




Jake went public afterward defended both his decision-making and mode of transport telling local TV station WBRZ:  "When you get a little too much to drink, why not ride a horse?  It's safer that way. The horse knows the way home."




Still, Jake who had a family member pick him and Sugar up and take them home, advised that he would not ride his horse home drunk again in future





Memo to the Folks:   While the definition of "motor vehicle" varies from State to State and not withstanding that a given State Legislature is free to make "intoxicated horse riding" a crime, a horse is not a motor vehicle and that makes it impossible to get a traditional DUI while at the reins.  Still, folks have been arrested for DUI while on a horse (click here for an example in Kentucky and click here for an example in Florida) but those cases are both rare and seem to get "broken down" to some form of public or disorderly intoxication.  In 2011 the Montana DOT published a public safety video using a drunken human on horseback as a metaphor to encourage folks who have been drinking to get friend to drive them home (you can watch the video, entitled "Sober Friend" by clicking here).  In the end, when it comes to the subject of drinking and driving, as with most things in life, it all boils down to being a matter of your own choice....




When it comes to the subject of drinking and driving, the best advice that you are ever going to hear is:  "Don't do it!  Get a DD (Designated Driver), not a DUI".


Be smart{like Jake Williams}: Don't drink and drive, but, if you do, just say "NO{thing}", don't blow (in FL your 2nd subsequent refusal is a crime) and call me stat at 305-381-8686, 305-798-2220 or 1-888-SHARK-8-1.
