On a "Dare" a 13 y/o Boy Kisses 14 y/o Girl at School and gets Himself Arrested for Assault ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1



Teachers at Pikesville Middle School, which is just Northwest of Baltimore, MD, called the police after a fourteen (14) y/o girl was smooched against her will on Wednesday, September 9th, 2015.




A thirteen (13) y/o boy was reportedly arrested for "second degree assault" after he kissed the unsuspecting 8th grade girl on a dare from his friends. 




The unwanted kiss took place during school hours after the boy had been "dared" to kiss his classmate by other students at the school. Baltimore County Police were called in and the boy now faces a second-degree assault charge as a juvenile.   I am not a MD lawyer and know less than nothing about MD law or procedure but quick research suggests that there are two (2) degrees of assault in MD, 1st and 2nd, the latter being less serious.  In MD 1st degree assault is a felony punishable by up to 25 years in prison and it is what FL would consider an "aggravated battery" (I can't explain why some jurisdictions interchange the crimes of "battery" and "assault" but that seems to be the case here): i.e.  intentionally causing or intending to cause serious physical injury to another or committing an assault with a firearm.  In MD 2nd degree assault appears to be any assault which does not qualify a 1st degree assault, is punishable by up to 10 years in prison and is considered to be a misdemeanor unless the victim is a LEO.  Apart from his impending prosecution the boy also faces potential disciplinary action by the school board, including suspension or expulsion.

Memo to the Folks (especially the younger ones):  Dares are almost always dumb. Be strong.  Be smart.  And don;t be a lemming.  It's okay to say "No".
