Meet Dwayne Smith. That's him below...
Dwayne's daughter, three (3) y/o Jamilla (who is pictured below), was killed on on September 18, 2014.
At that time Jamilla was being babysat by her mother's new husband (the baby's step-father), 34 y/o Clifford Thomas (who's mug shot appears below).
The mother, 25 y/o Jasmine Gordon (who's mug shot appears below), was at work while Thomas was at home, alone, with Jamilla and Jamilla's young brother. Sometime that evening Jamilla had to be taken to the hospital, where she stopped breathing. Gordon and Thomas claimed that the little girl had hit her head and then fell unconscious, but experts discovered bruises on her head and chest which showed signs of physical abuse, determined that the girl's death was a homicide and alleged that she had suffered physical abuse at the hands of Thomas.
Both Gordon and Thomas were found guilty of involuntary manslaughter in separate trials, but appeared in court at the same time on Friday, August 28th, 2015 for the sentencing hearing such that victims would not have to return to court a second time give their "victim impact statement" again. Smith was one (1) of the victims in court on Friday who was set to address the couple, but instead of speaking his frustrations he decided to physically attack Thomas, the man who is legally responsible for killing Jamilla. Video (which you can see by clicking here) was taken from inside the court shows the moment that Smith punched Thomas, as the convicted child abuser was sitting, facing the judge, dressed in a yellow jail uniform. A fight broke out between the two (2) men and Sheriff's Deputies quickly separated them. After the fight, Smith was ordered out of the courtroom and now allowed to return, but the judge decided not to hold him in contempt of court, and he was allowed to go without facing any charges for the tussle.
The court took a recess after the fight but resumed shortly thereafter with the Judge sentencing Gordon to serve concurrent terms of 7 - 15 years for involuntary manslaughter and 14 - 25 years for 1st degree child abuse (for her role in aiding and abetting Thomas) and Thomas was sentenced to serve 6 - 15 years for involuntary manslaughter and 1 - 2 years for resisting and obstructing a police officer. Memo to Dwayne Smith and the Folks: I cannot fathom the pain and anguish that a parent who loses a child, in any way but especially at the cruel hands of another, must feel, and, just like the sentencing Judge, I do not begrudge you failing to control yourself and punching your daughter's killer. In fact, I praise you... NOT for doing what, I suppose, any parent in your position would dream (but likely not have the cojones to actually do) of doing, but for showing restraint, and not taking it further, and going all "A Time to Kill"...
