In Florida the very same law violations can be treated quite differently depending upon the age of the person who is arrested.   The age of adulthood in Florida is eighteen (18) .  If you commit a non-capital crime (all capital crimes are adult system cases) and are eighteen (18) or over then you automatically go into the adult system; conversely you commit a non-capital crime and are eighteen (18) or less then you automatically start in (but do not necessarily remain in) the juvenile system.  




These two (2) systems are very different, the biggest difference being philosophical.  In adult court the idea is to impose punishment whereas in the juvenile system the primary goal is to rehabilitate (i.e. to provide means and services to stop a juvenile offender from graduating into the adult criminal system).  With the juvenile system's philosophy comes a host of procedural differences, perhaps the largest of which is the involvement of the DJJ (Department of Juvenile Justice) in an effort to "help" the juvenile offender (and sometimes her/his family) to help her/himself.  




The juvenile process is oftentimes more time consuming, demanding and otherwise "involved" in your affairs / life, but it is also confidential and will not be subject to public records or anything but full-bore law enforcement criminal history searches.




In many cases the State Attorney has wide discretion to decide whether or not to file charges against a juvenile in either juvenile or in adult court.  In these circumstances a skilled and experienced criminal defense lawyer can help you to decide where you want the case to be heard (there are advantages and disadvantages to both systems and each unique case will require it's own independent analysis) and then focus efforts on preparing and  effectuating a plan to make that happen.
