Crazy is as crazy does: Wild Eyed GA Fugitive Tries to Eat Crack Cocaine During Arrest ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




Meet 48 y/o Linda Blank.  That's her in the crazy-eyed mug shot below...




For reasons unknown cops in Douglas, Georgia stopped Linda on the street and determined that she was wanted on theft charges and had a open probation warrant. As the arrest process began Linda produced what is described as "a small amount of crack cocaine" and tried to eat it.  Cops were about to stop her, confiscate the crack and add an additional charge of drug possession to Linda's laundry list of pending criminal problems.  (You can watch the WALB Channel 10 news report on this story here.)  Memo to Linda:




Second memo to Linda:  Yes, you have some crazy eyes, but not quite this crazy...




Memo to the Folks:  I don't know either the "how" or the "why" of the initial encounter between Linda and the cops but I do know that in order to detain you the police need to first have both a reasonable and articulable suspicion that you did commit, were committing or were about to commit a law violation.  If the cops simply approach you on the street you are under no obligation whatsoever to talk to them, and you do so at your own peril (if, of course, you have anything to hide / worry about).  A detention by law enforcement implicates the 4th Amendment and that means that your friendly neighborhood criminal defense lawyer will likely have fodder for the subsequent legal pyre.  You do not need to either incriminate yourself or make it easy on or for the cops.  Feel free to go about your business and if you are not permitted to do so then politely invoke and demand to speak with your lawyer.
