What do I do when a Traffic Ticket lawyer screws up my case? ~ "Best Answer" on AVVO ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Q:     After getting a ticket for running a stop sign I retained a traffic lawyer but the clerical staff failed to file the case.  After getting a ticket for running a stop sign I retained a traffic lawyer but the clerical staff failed to file the case . I almost got my license suspended finally the lawyer got the FIRST court date for June 16th and I got a notice for suspension to go into effect on the 17th of June please advise me what to do I live in Hollywood, Florida and every time I call the office I keep getting the clerical staff that screw the whole thing up.

Answered I am assuming that you hired a "ticket mill" These guys are generally very good lawyers, spending a lot of time in traffic court and being intimately familiar with the rules, procedures, Judges and even the cops, but they are "mills". They handle so many cases that it is not uncommon for some to fall through the cracks. However,, they too know this and they will almost always honor their foreseeable errors.

That said, you have 3 choices: 1) Contact them (in person in necessary) and demand that they make it right (which they should absolutely do); 2) Hire another firm to "fix" the matter (in which case you should invoice your old firm for the costs of the new one as well as any attendant costs); or 3) Handle it yourself.

In any event, what happened to you is inexcusable and you can, if you choose to do so, report them to the Florida Bar (there is a "grievance process" which can be found at the following link:http://www.floridabar.org/attorneydiscipline).
