With separate charges and a VOP, how do I determine my FL prison release date? / AVVO ? Best Answer / Michael A. Haber, Esq. **ARRESTED / **MIAMIDUI

Q:     Sentenced to prison for VOP , 3 charges. 1 and 2 are together and count 3 is separate . Was given 40 months and told when I left Polk that I had 968 days time served . But each charge had different amounts of time . Will all 3 be counted as individual sentences or are they added together . VOP consisted of all 3 charges Just concerned that time served will not be counted collectively . Help me understand this please. Thanks

Answered Once you are transferred into State custody from local you will go to a classification center for DOC processing and designation to a facility. This usually takes a few weeks and then you are "delivered" to your FL-DOC institution.

Once you get there you can track your release / proposed release status at the following link:

http://www.dc.state.fl.us/inmatereleases/search.asp

I suggest that you wait until DOC does their calculations and you have had a chance to review their math. If you have any issue after that then you can discuss the matter directly with your classification officer and, if you remain unsatisfied then you can calender a motion with the court.
