Johnny has 9 prior DUI convictions...
At 2:30 pm, on October 12th, 2014), during a traffic stop for his alleged erratic driving, when confronted by Wisconsin cops as to the source of the odor of alcohol that the Adams County Deputy smelled on his breath Johnny blamed the "beer battered fish" which he has eaten for lunch.
Johnny was given roadsides and a breath test and he blew UNDER the legal limit (his BAC was .062, which is appreciably less than the threshold .08), yet Johnny was still arrested and charged with his 10th DUI. Apparently the Deputy believed that Johnny was both lying and more banged up than his BAC suggested, perhaps due to....
OR.... perhaps it had something to do with the facts that Johnny was driving with a revoked license had that he had an open Red Dog beer on his passenger seat...
Memo to the folks: 2 things: 1) Many times its the little things that get you (you know, like the revoked DL and the open container, both of which are, in FL anyhow, arrestable offenses independent or in conjunction with a DUI; and 2) It is not illegal to drink and drive; it is illegal to drink and drive with a BAC of .08 < ____ or where your "normal faculties are impaired" due to booze, controlled substances or a combination of the same.
Memo to John Przybyla: You are a repeat DUI offender (9, now 10 times) with no license to drive. Wtf are you thinking A) driving, B) drinking and C) having an open beer in your car? You are a most inconsiderate man. You are inconsiderate to yourself and your family, to your neighbors, your community and to society in general and, most importantly, you are inconsiderate to your criminal defense lawyer who, BUT FOR the Red Dog in your car, may have actually enjoyed a shot at exonerating your inconsiderate ass....
When it comes to the subject of drinking and driving, the best advice that you are ever going to hear is: "Don't do it! Get a DD (Designated Driver), not a DUI".
Be smart{er than John Przybyla}: Don't drink and drive, but, if you do, just say "NO{thing}", don't blow (in FL your 2nd subsequent refusal is a crime) and call me stat at 305-381-8686, 305-798-2220, **ARRESTED, **305DUI, **MIAMIDUI, **MIAMILAW or **HABERLAW.
