Bad Driving Leads to Arrest for Serious Charges, & a Punch Line in this Florida Man's Arrest Affidavit ~ Call Michael A. Haber, Esq. @ **ARRESTED





Ah, the stupid things that people say to cops... They never cease to either amaze or to entertain.




Take, for instance, the case of 25 y/o Robert Phillips... Yup, that's him below...




Bobby was driving his stolen Hyundai, complete with a firearm and a a trafficking amount of heroin (22 grams, which carries a potential 30 year sentence... make that "life" because he was in possession of a firearm at the time.. with a 15 year "minimum mandatory day for day term of imprisonment), in West Palm Beach on Tuesday, February 3rd, 2015, when he cut in front of an unmarked Sheriff's vehicle, nearly causing a crash and attracting some seriously unwanted attention.




Rather than conducting a traffic stop (which a marked officer who was on routine patrol would have done) the detective followed Bobby, radioing in the plate and determining that the vehicle had been reported stolen.  At that point the detective, as a good and smart detective should, requested backup and followed Bobby in a clandestine fashion.  In short order Bobby stopped the vehicle and the detective observed a "hand-to-hand" transaction occur, during which time marked patrol units arrived causing Bobby to jump back into his stolen vehicle and flee.




Bobby pulled into a commercial parking lot, bailed out of the vehicle and ran into an art's store, where he mowed over a female patron, knocking her to the ground, and tossed his loaded firearm.  He then ran out of the back of the store, right into the cordon of cops who were there waiting for his predictable exit.  The search incident to arrest revealed 22 grams of heroin and $2,316.00 in cash, and a search of the stolen Hyundai produced 5.3 grams of crack cocaine as well as a drug scale and some hypodermic needles.  




Prior to last Tuesday Bobby had more than a dozen Palm Beach County, Florida arrests, seven (7) of them felonies and he served most of 2011 in prison.  He is now charged with possession of a firearm by a convicted felon, possession of cocaine with intent to sell, trafficking in heroin, resisting arrest with violence, possession of paraphernalia, fleeing and eluding at high speed, striking a police K-9, battery and driving on a suspended license.  And, for his coup de gras, during the booking process when asked his occupation Bobby allegedly replied "drug dealer". (I say allegedly because, while Bobby is undeniably a career criminal I have a hard time believing that he's that freaking stupid; that an I certainly wouldn't put it past the cops to have taken a little "literary license" when filling in their paperwork.)




Forgetting the fact's that he's a really bad drug dealer, in this case Bobby did EVERYTHING wrong. A "good" drug dealer would NEVER drive a stolen vehicle, would be more secretive in her/his transactional efforts, would know better than to pack heat - as that bumps the case up to a "life" felony - wouldn't be driving at all but, if s/he were then would be paying careful attention to the road were s/he driving, etc.  All in all this is an Epic Drug Dealer FAIL!  Tony Montana would not be proud.
