FL Woman Pulls Off a Hat-Trick with 3 DUI Arrests inside of a Week ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

According to various news sources, including Tampa, FL's Local 10 News (note that I could not find the arrest affidavit's online to verify the story), for Jen, three (3) is NOT a charm...




Channel 10 indicates that Jen was arrested in Bradenton, FL on April 30th, 2015 for DUI.  She was allegedly released on $500.00 bond the next morning and managed to get arrested for a second DUI later that day (the same day that she had bonded out for DUI #1), again refusing to provide a breath sample and being released on a $500.00 bond.  Five days later, on May 5th, 2015, Jen was arrested for her DUI #3, this one involving an accident with property damage.  She refused breath again and this time the Judge refused to give Jen a bond, so in the Manatee County Jail she sits.




Memo to the Folks:  Anyone who drinks (or who uses meds, Rx or otherwise, or who combines the two) can get arrested for DUI.  It is a simple poor decision which can happen to anyone, and most of the folks that it does happen to are otherwise good, law-abiding citizens who caused no harm in their first "transgression". While many a DUI is properly made by law enforcement, some are not, and many are defendable cases for one reason or another. What is not defendable (although there may well be applicable mitigation... I know that that is where I'd be going with Jen Yi were I her attorney) is a "three-peat".  And what is similarly undefendable is her triple refusal as, in FL it is an independent, and essentially a "strict liability", crime to refuse a breath sample for a second, much less a third time.  Jen's "Hat Trick" reportedly has her remaining in jail without bond because a Judge has apparently determined that she presents a significant enough danger to the community so as to justify her continued incarceration and the denial of bond.  Jen.... This is a "Hat Trick:...

Aside from the problems that Jen Yi has brought upon herself she has also done a disservice to all of those otherwise good folks who made one poor choice and got themselves a DUI.  Every douchette like Jen makes MADD, the Legislature, the Prosecution and even the Judges to come down harder on everyone else.  Penalties for "simple" first time DUI's continue to stack.  The fines and costs have become astronomical, the classes and time necessarily spent on mandated activities have become a part-time job and the unavoidable collateral consequences (like installation of ignition interlock devices and vehicle impoundments) are onerous at best.  Again, almost anyone can get (and survive) a DUI, but repeat offenders present a problem for everyone, and...  




When it comes to the subject of drinking and driving, the best advice that you are ever going to hear is:  "Don't do it!  Get a DD (Designated Driver), not a DUI".


Be smart{er than Jennifer Yi}: Don't drink and drive, but, if you do, just say "NO{thing}", don't blow (in FL your 2nd subsequent refusal is a crime) and call me stat at 305-381-8686, 305-798-2220, **ARRESTED, **305DUI, **MIAMIDUI, **MIAMILAW or **HABERLAW.
