Do sentences from different counties run concurrently? ~ "Best Answer" on AVVO.com ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Q:    What does "JACS- Modification of probation" mean?  A friend of mine was sentenced to 11/29. She did school & meetings etc to get credit & 55 days off sentence. However she also has a charge in the next county that was violated as well & now has a hold on her until this 11/29 is served. I put a motion in last month for the case to be re-opened & evaluated. It now says pro-se motion requesting resolution of probation & on 6/29 there will be a jacs- modification of probation hearing. Will this run the charges concurrently? Is there a chance she will be transferred to manatee county for this hearing? Its all confusing to someone who has never been in jail or trouble lol I'm just trying to help.

Answered Charges will not run concurrently unless the second (the one which came later in time) Judge specifically Orders that the sentences be run concurrently with one another.

I don't know what the "6/29 there will be a JACS- modification of probation hearing" will involve.  I do know that whatever relief the written motion itself seeks is what will be heard, discussed and presumably resolved.  Thus, if the issue of concurrent sentencing was requested, then that will be addressed on 6/29. Conversely, if the motion concerned something else then whatever that may be is what will be litigated on June 29th.

If she has a scheduled hearing in one county while she is being housed (is in jail) in another county and you want to ensure that she is transported for the hearing then her lawyer should file a timely motion seeking an order to transport her. (When it comes to Court a good rule of thumb is to assume nothing and to plan for everything.)

If you really wanna help her then hire her a lawyer.  If she already has a lawyer then seek her formal permission to speak to her lawyer. Only her lawyer can dispel your confusion.
