How do you pursue Harassment and Cyber-Stalking Charges when the person who did this is from another State? ~ "Best Answer" on AVVO ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Q:     Someone from another State continues to consistently harass me with Internet postings. What can be done from another State I reside now? This person had a final judgment Restraining Order against him, and now continues with online intimidation and postings.  How can I go about filing harassment and cyber-stalking when the person who did this is from another State?

Answered Go to your local police department with printouts or your smart device and make a report.

If they believe that a crime has occurred then they will forward it along to the PD in the corresponding area where the subject resides.

This happens with great regularity.

As for the DVRO is it still in effect? If it is then you should be able to get a contempt order and a bench warrant issued quickly. You should also be able to have local charges filed and an arrest warrant issued on a new local felony case for violating the restraining order. If the DVRO is not in place (has expired) then bring that with you when you file the police report for harassment and cyber-stalking as it will further support your claim and likely help to convince the cops to take it seriously and do the necessary leg work to follow up.

If the DVRO is expired then you could also apply for a new one based upon these subsequent criminal acts.

I hope that I have been helpful in answering your question.
