NY Mother Survives Rollover Wreck on the LIE but is Killed Minutes after when she goes back to Wrecked Car to get her Purse ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




I could not find a photo of 25 year old Brittany Leith of New York, mother to a three (3) year old girl, who somehow miraculously escaped a brutal auto accident where her 2006 Nissan Sentra hit the center median and flipped over onto its roof on Long Island's Southern State Parkway at 3:54 am on Sunday, November 29th, 2015.





Brittany amazingly managed to clamber out of the wreckage through a cracked window and was helped to the roadside by other good samaritan drivers.  Despite being begged to sit tight and wait for first responders Brittany went back to her vehicle to grab her purse and collect her belongings.





As she traversed the LIE and walked back to her car Brittany was hit and instantly killed by another car which was driving down the highway.   That driver was neither cited nor arrested as he was attempting to avoid the accident and had no way to predict that Brittany would be playing Frogger at almost 4 am.





To make matters worse (not that they could get worse for either Brittany or her three (3) year old daughter) a State Trooper arrived moments after Brittany was struck and both he and his squad car were also struck by yet another moving vehicle, causing the Trooper to be taken to the hospital.  





Florida Statute 316.186 is the "Move Over Law" (you can read it by clicking here) and it basically requires that whenever there is an emergency vehicle on the roadside all drivers must vacate the lane closest to the emergency vehicle and must also slow to 20 mph BELOW the posted speed limit.  FL-DMV has a public awareness website (which you can access by clicking here).  Many States have similar laws.  It's not rocket science... 





It's just good old fashioned common sense.  Unfortunately,





Memo to the Folks:  Please pay attention to the road when you are driving, and for ____________'s sake, please MOVE OVER  for emergency and disabled vehicles.  Oh, and please do not play Frogger on the LIE....  If you do then you may find yourself in either Brittany or her grandmother (73 year old Claire Hansen) shoes (i.e. dead or having to figure out how to break the news to Brittany's (your) daughter.  "We have to tell this little baby, this little doll,' Hansen said. 'How do we tell this little girl? . . . She keeps saying, "Where's Mommy? Where's Mommy?" It's not supposed to happen this way.")
