Motorcyclist Tries to Pass Car and gets Caught in Road Rage Incident as Car Driver Swerves into and Sends Biker and Passenger Flying off the Road ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Was it an accident caused by a wasp sting or was it an intentional act?  Decide for yourself by watching the video (click here) which was filmed by a helmet-cam worn by Brian Fisher, another motorcyclist who happened to have been following Eric Sanders and his girlfriend Debra Simpson as they tooled along in tandem on a two lane double yellow-lined Texas roadway on Saturday, October  17th, 2015.

The video shows Sanders driving along and moving left to pass (not withstanding the double yellow line) a couple of cars, the last of which suddenly swerves left also, clipping the would-be passing motorcycle and causing a full-speed wipeout.

The impact sends the motorcycle flying and Sanders and Simpson tumbling onto the roadway, and then into a field next to the road.  Sanders is seen in the video quickly jumping up and taking off his helmet following the crash as Simpson lies still in the field.

Fellow motorcyclist Brian Fisher, still filming, goes to check on Simpson asking her "Are you okay?" before telling Sanders that "I got it on video".  Fisher then approaches the driver of the car who hit the couple asking him "What were you doing? You hit them.", to which the driver immediately responds "I don't care".

After repeating his position (that "I don't care") the driver then states that the couple had tried to pass him on double-yellow lines and that he had been "stung by a wasp".

"You will care" Fisher responds before taking a picture of the man's license plate, and he then returned to the couple, where a number of concerned drivers have stopped their cars to check on Simpson as she laid injured in the field.

Simpson, who is pictured below, had to be airlifted to an intensive care unit following the crash and suffered a broken wrist.   It is unclear whether Sanders' claim that his girlfriend suffered road rash that "took her arm down to bone and tendon from her elbow to her wrist" and that she will undergo multiple surgeries as doctors attempt to repair her arm is accurate.

Sanders would later write in a Facebook post that he attempted to pass the man over double-yellow lines because the driver was going 40 miles per hour in a 60 to 65 mile per hour zone stating that "On impact I was only going about 60 or 65 miles an hour. I was not speeding. I did not get a ticket for passing in a no passing."  Sanders also said that the man was not arrested by police at the scene but that officers have seen the video and that the driver is "gonna be prosecuted".

Naturally I don't know who's telling the truth but I do know that actions speak louder than words, and in this case the car's driver's actions do not appear to support his claim that the wreck was accidental (caused by a wasp sting) and they certainly do not objectively show a man who has any concern for his accidental actions.  Rather, the driver's words and acts suggest that he is neither concerned nor does he care (literally), and he presents as an angry road rage fueled douche bag.

Memo to the Folks:  I know (as do many of you) just how douche baggerous many motorcycle drivers can be - zipping around and in between cars at speed, at red lights, in emergency lanes - and I have often fantasized about such things as opening my car door... but thinking and acting are very, very different things.

Memo to Mr. "I don't care":   While it is true that Sanders was speeding, unlawfully passing and, as it turns out, did not even have a valid driver license (he was cited accordingly), I am calling BS on your "wasp sting" defense...

Memo to Mr. "I don't care" continued:  If you had been stung by a wasp, as you claim, then the video would have shown you itching, scratching or behaving as someone who had been stung by a wasp.  Instead, you presented as being confrontational and you showed no regard for the people who you - allegedly accidentally - may well have permanently injured or killed.   Tack on your own words ("I don't care") and I will be shocked if Texas authorities do not hold you criminally responsible (I'm guessing that you will be indicted for aggravated assault with a deadly weapon).  Like me, you can think anything you want, but you can't act on your sociopathic thoughts...
