Why would a Crime Victim go Visit the Defendant while he's serving a Prison Sentence? ~ Chosen as "Best Answer" by Asker on www.AVVO.com ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Q:     Being contacted by a dui victim while still incarcerated?  My fiance has been incarcerated for the last two and a half years for a dui with serious bodily injury. Recently the other driver and her pastor filled out visitation forms to try and visit him while he is still incarcerated. Of course since she was also involved in the accident the other driver was declined but her pastor's got approved. What could be the reason for them trying to contact him after all this time if he Was instructed not to contact her in anyway?

Answered .  Beats me.

How would I (or any cyber-lawyer) know what the motivation is for anyone to do anything?

If you want me to speculate then I would guess that the victim probably went either to make peace with her/himself, to make peace with your fiance, to make peace with her his deity or, way off on the other extreme perhaps s/he went to vindictively rub it in your fiance's face... either way I would guess that the pastor was there merely for moral support.

If you want to "know" then you would have to ask the person in question directly.

A no contact order is a one way street, Your fiance cannot contact the subject of the order but the reverse is not true, especially when he is in custody and the victim goes to the correctional facility.

I hope that I have been helpful in answering your question.
