Q:     My boyfriend accused me of kidnapping our baby because I left the US while I was pregnant.  Can he press charges for this now that we're fighting over custody?

Answered He can try.  But there is no baby and he is not yet a biological father.

Generally a parent cannot kidnap her/his own child but you are also not permitted to remove the child more than 50 miles from its residence in the State of Florida without either the consent of the other parent or permission from the Court. However, again, you don't YET (caps intentional) have a baby and he is not YET (again, caps intentional) a father.

You will more like'y have a family court problem than a criminal court problem so I am going to re-tag this question from "violent crime" (which your proffer does not involve) to "family law" in the hope that you will get some advise from a lawyer who is more properly attuned to these issues.
