What to do about a lawyer who doesn't respond to me and failed to show at a hearing? ~ Chosen as Best Answer on AVVO ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Q:   Bad Attorney or something else?  I'm involved in a very ugly paternity case that has dragged on for 16 months, and I am on my 3rd attorney. With the first two, I had limited income and made the mistake of getting the cheapest counsel I could find. I got what I paid for. Borrowed money from my parents for this third attorney who came highly recommended however he has done absolutely NOTHING since April. He doesn't answer questions, emails, was a no show for a phone conference, and even failed to inform me of a hearing that had been scheduled. I got a call the day of the hearing and of course there was no way I could make it. He basically told me if I forked over several hundreds to the opposing side, a stipulated order could be done and the matter would be resolved. I was furious and felt taken advantage of. I've been more than patient and have contacted him once a month, if that. I have a support order that needs to be adjusted due to change of income, I've asked him 3 times in the last three months without any response. This whole process has been very emotional and depressing and I fear that no new attorney would ever want to be the 4th attorney on a case. What should I do? Is this grounds to file a complaint?

Why did you list this as a criminal defense question?  If it is a paternity case then it is a paternity law question.  As AVVO does not have a "paternity" category I suggest that you rep-post your question in either the "family" or the "child support" category.

That said and regardless, here's the bottom line: If you feel that your lawyer has failed to perform ethically or has otherwise violated his oath as a lawyer then you should file a grievance with the Florida Bar and let them decide if your complaint(s) has (have) merit.

Bad lawyers reflect poorly on good lawyers and it's important to call them out.

Thank you for your response! I posted without selecting a category by mistake. I think that was the default choice and I can't figure out how to change it now. I will look into your suggestion.
