Meet 22 y/o Alex Direeno of the mean streets of Bradenton, FL (which, given her circumstances is not a nice thing to say, and I apologize, as Alex is reportedly homeless, a condition that I wish on no one but which, apparently also does not prevent my sarcastic streak... any-who...). That's her below....
Alex was arrested, presumably during a sting op, by an undercover Manatee County, FL Deputy Sheriff, and was charged with both prostitution and possession of drug paraphernalia.
Apparently, after being invited into the deputy's car at a Marathon gas station, and under the guise of being a John who reportedly "wanted to get [his] d*ck sucked", Alex offered the U/C Deputy oral sex in exchange for $25.00 and an unspecified amount Chicken McNuggets (presumably to drown down the taste... there I go again...).
The couple drove off, as soon as the price was agreed upon the U/C displayed the cash and then, like magic, out of nowhere, a swarm of detectives swooped in....
A search of Alex's purse - incident to her arrest - disclosed drug paraphernalia (in the form of hypodermic syringes, small baggies, a spoon and a burnt glass pipe), so at least the Manatee County Sheriff's Office can consider this a major collar.
Memo to the Folks: This case was paid for with tax dollars. In this case it was only at the expense of Manatee County, FL residents, but believe me when I tell you that most every police department wastes both tax money and their limited resources on precluding commerce and consensual adult activity, instead of either solving or preventing real crimes. This is plain old...
Memo to the Folks continued: As for Alex, because she was predisposed to commit the offense, no, she was not entrapped. The law is clear that it is not entrapment just because the cops (or their CI) provided you with the opportunity, means or facilities to commit a crime, or even that they used trickery or subterfuge in the process, or even that they were present and pretended to aid or assist you in the commission of a crime. Rather pleading entrapment succeeds or fails on the issue of your “predisposition” to commit the offense, and you were “predisposed” to commit an offense if you were ready and willing to do so when the opportunity presented itself, regardless of police involvement, persuasion, trickery or subterfuge.
