Can I be charged with a Cyber-Crime like Stalking, Harassment or anything else for sending one Facebook Instant Message across State lines? ~ Chosen as "Best Answer" on AVVO ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Q:     What can happen? Can charges be pressed from out of state for this?  I am in GA and sent my ex girlfriend family that's in Boston a Facebook Instant Message that she is pregnant and she is hiding it from them. They felt harassed and want to press charges.  It was only one message, no phone calls, other messages etc.

Answered If she is pregnant then they have bigger issues to worry about than you or your lone Facebook IM.

My advise:  Do not contact any of them (especially her) again. CEASE & DESIST (caps intentional)... or not... it's your life.

You should not have a problem with the cops based on this proffer. A lone, non-threatening text is not a cyber-crime (it is neither cyber-harassment nor is it cyber-stalking). On the other hand, continued unwanted contact, and most especially after a warning, may constitute a crime.

Be smart:  Don't poke the bear.

Move on.

Leave those people alone.
