If there is no DNA why would a person get Life in Prison for Sexual Assault + 15 Years for Battery? ~ Chosen as Best Answer on AVVO ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Q:     Why would a person get life for sexual assualt, + 15 years for battery?  In Florida, a man beat up a woman badly, and sexually assaulted her, though there was no DNA to back up that charge . The sentence is 15 years + life.

Answered Q: Why would a person get life for sexual assualt, + 15 for battery?

A: Because apparently the Jury did not need DNA evidence to reach it's verdict in finding him guilty beyond a reasonable doubt of a felony punishable by life and another punishable by 15 years and the Judge apparently believed that the person presented a significant enough danger to society to make sure that he remains behind bars for years after his death.

That said he may or may not have grounds to appeal his conviction and sentence but that is an appeals question and it needs to be addressed to an appeals lawyer.

Wishing you luck and hoping that I have been helpful in answering your question.
