A Miami, FL Private School is now selling Bullet Proof Ballistic Panel Inserts for Student's Backpacks ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Florida Christian School, a K-12 in Miami, FL is Selling "binder-sized" "Ballistic Panels" (bullet proof inserts designed to stop pistol rounds that are manufactured locally by one of the school's student's parents) on the school's Website for $120

Florida Christian School is a private K-12 in Miami, FL, and, because of it's most recent and innovative partnership, it has made the news.

It all started with Alex Cejas, who is the parent of a Florida Christian School student who happens to run a Hialeah, FL based company called Applied Fiber Concepts, a manufacturer of body armor and tactical gear.

As a concerned parent Alex (pictured below) started stuffing his company's bullet proof panels, which are reportedly capable of stopping bullets including .44 and .357 magnum rounds, into his son's school backpack.

And when this came to the attention of George Gulla (pictured below), a former police officer who is now the school's head of security, he thought that it was a great idea and so he pitched it to the school administration.

In light of the aggressive "active shooter drills for students and parents" that Gulla routinely runs, and in tandem with the preexisting advise that all student's wear their backpacks tightly on their chests (as opposed to their backs) so as to protect their "center mass" in the event of a shooting, the school decided to start selling the $120.00 binder-sized bulletproof panels right on the school's website.

While there are critics of this decision the school stands behind Gulla, who says that he'd rather be prepared for the worst than be stuck afterward. Gulla has installed security cameras in the school, as well as implementing patrols by uniformed guards, and as to all of his security precautions he says that parents have mostly reacted positively, but he also stated that several parents have called him to talk about "a different time, a different world", when giving children body armor wasn't something one had to consider. Yup...

But those days are gone. Long gone. And Alex Cejas believes that his bulletproof panels (which are designed to stop a wide range of pistol ammunition but which don't protect against rifle rounds) provide better peace of mind, stating: "While books and stuff in your backpack may stop a bullet, they’re not designed to. I wouldn't bet my life on it." For what it's worth, I have no issue with my son having such a panel in his backpack. In fact I intend to buy him one, stat.

The State of MA Dept. of Agriculture needs to hire an Inspector to serve as it's official "Cannabis Connoisseur" ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

In anticipation of Massachusetts' 2016 Law providing for the Imminent Decriminalization of Marijuana in 2018, and so as "enforce the laws and regulations involving hemp and overlapping laws and regulations that impact the cultivation of marijuana" the MA Department of Agriculture is looking for an "Agricultural Inspector" (a/k/a a "Cannabis Connoisseur")

Per a November 3rd, 2017 posting on "MassCareers Job Opportunities" (which is an official Commonwealth of Massachusetts / Mass.gov website and which you can access by clicking here), in anticipation of the State's imminent decriminalization of marijuana which is set to occur on July 18th, 2018, Massachusetts is looking to hire a "Cannabis Connoisseur".

The State's Department of Agricultural Resources job description formally seeks an "Agricultural Inspector" who's "position will enforce the laws and regulations involving hemp and overlapping laws and regulations that impact the cultivation of marijuana. This position implements and enforces: M.G.L. 128 Section 116-123, M.G.L.c. 132B and any other overlapping laws or regulations within M.G.L.c. 128. This position will consult with division management with the creation and enforcement of rules and regulations relative to hemp. This position consults and coordinates with state, local and national agencies as well as division and agency management. This position will provide education and outreach to stakeholders relative to the enforcement of pertinent laws and regulations. This position will be required to provide reports and summaries on the inspections and investigations that are conducted."

In Fall, 2016 Massachusetts voters legalized marijuana and come July 2018 adults in Massachusetts will be able to lawfully buy, sell and smoke marijuana. The problem: Regulation, and unlike other pioneering States, Massachusetts legislators chose to put the entire legalization process on hold for a year while they tackle the details and try to avoid some of the proven pitfalls.

The job pays between $42,391 and $57,762 a year and the preferred qualifications are:

A Bachelors’ Degree or higher in Agronomy, Biology, Chemistry, Plant Pathology, Entomology, or related fields
Has experience or knowledge about Cannabis and how it is regulated in other states.
Has had field experience in a biological setting.
Has experience with enforcing rules and regulations.
Candidates must also be familiar with safety practices and procedures, testing methods and techniques.
Candidates must be familiar with inspection methods and techniques.
Candidates must be able to communicate effectively in written and oral expression and be able to work independently and adapt to varied work situations.
Ability to compose relevant standard operating procedures, policy guidelines, compliance documents and other documents.
Ability to synthesize knowledge of business, legal and policy guidelines regarding data practices, documents and records management.
Ability to read, understand and relay information relative to laws and regulations.
Experience working with legal and administrative procedures sufficient to evaluate and solve problems and implement new procedures.
Must possess and maintain an active valid drivers’ license with an acceptable motor vehicle record subject to review.

The MA Department of Agricultural Resources is tasked with establishing health and safety standards regarding "cultivation processing, manufacturing and distribution of marijuana" (so that people in MA can just "chill").

A FL Woman was Arrested for DUI & Animal Neglect for Riding her Horse on a Public Road with .161 BAC ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Equine FAIL! After Sheriff's Deputies observed a FL Woman Riding her Horse on a Public Roadway and her BAC tested at .161 (double the Legal Limit) she was Arrested for DUI and Animal Neglect (for endangering the horse by riding her while impaired)

Meet 53 y/o Donna Byrne of Polk County, Florida. That's her (latest) mug shot below.

Donna, who reportedly has some 10 misdemeanors and 5 felonies (including animal cruelty and drug possession) under her belt can now add 2 more to her resume, DUI and animal neglect.

On Thursday, November 2nd, 2017 a concerned citizen dialed 911 and advised the Polk County Sheriff that a woman who appeared confused and who was possibly in danger was riding a horse in the roadway. Deputies weer dispatched and when they arrived, sure enough, Donna was riding her horse in the road.

After failing field sobriety tests Donna consented to breath and blew .161, double the legal limit of .08 BAC, leading to her arrest for both DUI and animal neglect (as she is accused of endangering and failing to provide proper protection for the horse - who is pictured below).

Per Polk County Sheriff Grady Judd: "Ms. Byrne was obviously not in any condition to be on the road. She not only put herself and the horse in danger, but also anyone who was driving on the road, which is typically very busy." Deputies reportedly took the horse to the Polk County Sheriff's Animal Control livestock facility... Donna, on the other hand, was booked into the Polk County Jail.

Memo the the Folks: Yes. You can get a DUI on a horse in FL.

Memo the the Folks: In fact you can get a DUI on all sorts of things in FL. The DUI statute (F.S. 316.193) says that:

(1) A person is guilty of the offense of driving under the influence and is subject to punishment as provided in subsection (2) if the person is driving or in actual physical control of a vehicle within this state and:

(a) The person is under the influence of alcoholic beverages, any chemical substance set forth in s. 877.111, or any substance controlled under chapter 893, when affected to the extent that the person’s normal faculties are impaired;

(b) The person has a blood-alcohol level of 0.08 or more grams of alcohol per 100 milliliters of blood; or

and in FL a "vehicle" is defined in F.S. 316.003(97) as:

Every device in, upon, or by which any person or property is or may be transported or drawn upon a highway, except personal delivery devices and devices used exclusively upon stationary rails or tracks.

SO.... In FL you can be arrested for DUI for operating all sorts of things from a motor vehicle to a horse to a bicycle to a a golf cart to a wheelchair (motorized or not). In FL it matters less what you are operating than it does the manner in which you are functioning while you are doing so. Always remember...

Memo the the Folks continued: And also please, pretty please, BE SMART{er Than Donna Byrne}: Don't drink and drive (even a horse), but, if you do, just say "NO{thing}", don't blow (in FL your 2nd subsequent refusal is a crime) and call me stat at 305-381-8686, 305-798-2220 or 1-888-SHARK-8-1.

When it comes to the subject of drinking and driving, the best advice that you are ever going to hear is: "Don't do it! Get a DD (Designated Driver), not a DUI".

Former Ms. KY is Arrested for Bringing Pot into Jail for an Inmate because Authorities Monitored Conversations ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Former Beauty Pageant Model goes to Visit Man at Jail and is met by Authorities with a Body Cavity Search Warrant because of Information gathered during Monitored Telephone Calls with the Inmate, Marijuana is Found and she is Charged with Felony Introduction of Contraband into a Correctional Facility

Meet 28 y/o Kia Hampton, a former beauty pageant winner from Kentucky. That's her below...

Kia was crowned Miss Kentucky USA in 2011, reportedly being the first African-American woman chosen to represent Kentucky in the Miss USA Pageant.

Kia has fallen from grace, having been arrested on May 26, 2017 for smuggling marijuana into the Allen Correctional Institution in Lima, Ohio.

Her introduction of contraband into the correctional facility was anticipated by authorities who had been eavesdropping on her telephone communications with inmate Jeremy Kelly.

Armed with the knowledge that she was planning on smuggling pot into the jail for Jeremy authorities were prepared, having secured a search warrant prior to and in anticipation of Kia's arrival at Allen Correctional.

And it was not just any warrant... it was a warrant authorizing a body cavity search!

So when Kia arrived to "visit" Jeremy on May 26 she was immediately served with the search warrant, but apparently no one got the privilege as, while interrogating Kia she reportedly reached into her pants and dropped a white balloon containing 2.82 grams of marijuana to the floor.

Kia was indicted for a felony charge of bringing drugs onto government facility, which, in KY, carries a maximum 3 year prison sentence.

Memo to the Folks: Florida Statutes 951.22 and 944.47 define the crime of "Introduction of Contraband into a Correctional Facility" as being committed when a person 1) knowingly introduces, possesses, or attempts to introduce or possess, contraband intended for an inmate 2) into a county jail or state prison and 3) does not do so through authorized channels. Contraband is defined as being any written or recorded communications or currency, article of food or clothing, intoxicating beverage, controlled substance or non-prescription drugs that causes a hypnotic, stimulating, or depressing effect, firearm, weapons of any kind, or explosive substance and cellular telephones or portable communication devices.

Memo to the Folks continued: In FL the penalties for Introduction of Contraband into a Correctional Facility differ depending on whether the correctional facility was a county or state facility and on the type of contraband introduced. The minimum maximum penalty (meaning that the most time that you face for any violation of Florida Statutes 951.22 and 944.47 ) is 5 years in state prison and could be as much as 15 years in state prison. You have no right to enter a correctional facility (meaning that you can be denied entry) and entering a correctional facility subjects you to being searched. If you get caught either trying to enter or actually inside with any contraband then you will be arrested, and this is one of those charges that is ridiculously easy for the government to prove. By the way, this applies to lawyers as well as to lay-folk (many an attorney has been arrested for bringing contraband into a jail).

Memo to the Folks continued: Just as you have no right to enter, you also have no right to privacy in a jail, and this holds true for both the inmate and anyone voluntarily entering (whether physically, by mail or by phone). When you physically enter you are subject to being searched, any mail that you send to an inmate will be opened and read (unless it is "legal mail" from a bona fide lawyer to an incarcerant - in which case it will be opened but not read) and any communications (be them in person or over a phone) will be recorded (and possibly live-monitored), so be aware and be smart. It's not only you that you need to protect but also the inmate (i.e. discussions about a pending criminal prosecution can be recorded and then introduced as evidence against the inmate later in court).

Memo to Kia Hampton: You too could look good in stripes...
