Thanks for asking me “Can Someone Else Pay My Legal Fees?”
In a word, “Yes”.
Anyone who’s appointed a Public Defender, Regional Counsel, Specially Appointed Private Lawyer or other Court Appointed Counsel has a lawyer who’s being paid by someone - actually someones - else... the taxpayers. Client’s who retain private counsel usually hire a lawyer of their own choosing, but third parties - be it a spouse, parent, sibling, friend, employer or other trusted person - also routinely hire lawyers for other folks.
That said - and apart from taxpayers funded lawyers - whenever a Third Party pays a lawyer on behalf of a Client there are three qualifications, all of which are outlined in Rule 4-1.8(f) of the Rules Regulating The Florida Bar.
1) THE CLIENT MUST GIVE INFORMED CONSENT: No matter who wants to pay a lawyer the Client must consent to be represented by the lawyer. In other words no one can force a private lawyer on you; they can try to hire a lawyer for you but in order for the lawyer to enter an appearance you must first agree.
2) THERE CAN BE NO INTERFERENCE WITH THE LAWYER’S INDEPENDENCE OF PROFESSIONAL JUDGMENT: Because the interests of a Third Party payer can (and often do) differ from those of the client, a lawyer must fully vet the situation. Lawyers must identify and explain potential conflicts and the Client must subsequently waive them with “informed consent” or the lawyer must decline payment and representation; and
3) INFORMATION RELATING TO REPRESENTATION OF A CLIENT IS PROTECTED AS REQUIRED BY RULE 4-1.6.: This concerns “Confidentiality of Information” and means that unless a Client grants express permission for her or his lawyer to disclose anything about the case to a Third Party Payer then the only thing that the lawyer can discuss with a Third Party Payer is the status of payment.
