This Blog Post is intended to serve three purposes: First and foremost it's a PSA (i.e. a "Public Service Announcement" that's designed to provide the folks with important information), it's part of the rollout of the latest batch of #HaberPA's VideoFAQs highlighting # 403) "Are Public Defenders “Real” lawyers?" - https://youtu.be/pl7-7qS9Kk   and it's a shameless plug for #MichaelHaberLaw (#HaberPA's YouTube channel).  Disclosures complete let's get to it:

YES... Public Defenders are real lawyers.  In fact most Public Defenders are very good lawyers - and many are great lawyers. It’s neither a stretch nor hyperbole for me to say I’ve seen more ineffective PRIVATE criminal defense lawyers than their PD counterparts. What do I mean?  I’ll explain...

I can’t speak to all PD Offices but after 35 years of working side-by-side with hundreds of Assistant Public Defenders here in The 305, first under the legendary and Honorable Bennett Brummer and then for years under the Honorable Carlos J. Martinez, I can tell you with absolute certainty that it’s not easy to get hired as, much less to remain employed, as an Assistant Public Defender.  With hundreds of applicants per spot it takes brains, ethics, effort and commitment to get the job - and it takes even more than that to keep that often thankless job. Attorney's who aren’t committed to it simply don’t last.

Still, despite mentorships, on-the-job training and non-stop CLEs (“continuing legal education classes), due to caseloads, many PDs can’t afford to offer the time and personalized attention that private lawyers are supposed to bring to the table (albeit at a price); but APD's are extremely well-versed in both the law, the rules, and maybe more importantly the nuances of their individual courtrooms.  While private lawyers bounce from courtroom to courtroom most PDs are assigned to specific divisions, so they know their Judges, their Prosecutors and the other instrumental court personnel, plus they bring vast resources such as investigators and experts to the table without expense to the client.

I want to take a moment to shout out to Carlos Martinez who goes both out of his way and above and beyond to include the private defense bar in his CLE courses. Private Criminal Defense Lawyers - like me - are better at what we do because of our PD’s selfless generosity. 

If you’re lucky enough to be appointed a Public Defender  (especially here in The 305) then please, pretty please even, say “thank you”.

Each #HaberPA VideoFAQ focuses on a specific question, most are 1 - 2 minutes long, but several in this latest batch are closer to the 3 minute mark (another relevant aside alert: "Necessity" is what we call an "Affirmative Defense", or a defense which negates the "intent" or Mens Rea" element of an otherwise criminal act as the actor's illegal conduct only occurred under threat, usually threat of harm), and while we may not always be successful in our endeavor we do consistently strive to make each VideoFAQ short, pointed, creative, entertaining and, most importantly, informative.
