Thanks for asking me “What do I do if my Lawyer Screws me over?”
Common ways that a lawyer can screw you over are:
1) LYING FROM THE GET-GO: Far too many lawyers inflate their profiles, be it online, in person or both, and hold themselves out to be “better” than they actually are, so it’s on you to vet a lawyer before hiring her or him. 2) MAKING UNETHICAL GUARANTEES: All private lawyers are business people who compete with their peers, and sadly many inflate expectations to get paid. While goals should be case specific no lawyer is ever permitted to “guarantee” a specific outcome in any case. 3) FAILING TO PERFORM AS PROMISED: Like politicians some lawyers can boast “promises made promises kept” - but many can’t. 4) PUSHING FOR A PLEA BARGAIN: Lawyers have an ethical obligation to convey any plea offer and it’s often the best way to resolve many cases but in the end it’s exclusively the client’s choice to make. 6) FAILING TO COMMUNICATE: Lawyers are ethically obligated to keep clients reasonably informed about case status, promptly respond to requests for information, and explain matters so clients can make informed decisions. 7) ASKING FOR MORE MONEY: Having a written retainer agreement should eliminate this problem.
Just like any important relationship - the moment that you notice any issue with your lawyer you’d be wise to address and discuss it, stat. If it’s unresolvable then no matter the “what, why or when” of it, if you feel that your lawyer has screwed you, irreconcilable differences exist and the relationship is irretrievably broken then your options are:
1) You can fire / discharge your lawyer at any time for any reason or for no reason so long as it’s not for an improper reason (for instance firing your lawyer on the day or Trial likely won’t go over well with your Judge) but you may be on the hook for any outstanding fees or costs. 2) You can file a formal grievance with the Florida Bar, a/k/a a “Bar Complaint”, but know that doing so is an effective declaration of war against your lawyer who’s then entitled to defend her or himself against your allegations, sometimes using otherwise privileged or confidential information. 3) You can try to sue your attorney for damages, but legal malpractice claims are notoriously difficult to pursue, much less to win.
