This Blog Post is intended to serve three purposes: First and foremost it's a PSA (i.e. a "Public Service Announcement" that's designed to provide the folks with important information), it's part of the rollout of the latest batch of #HaberPA's VideoFAQs highlighting # 417)  What are the Rules about Buying a Gun in Florida? - https://youtu.be/UOiorCOuGpk and it's a shameless plug for #MichaelHaberLaw (#HaberPA's YouTube channel).  Disclosures complete let's get to it:

- The PSA: #HaberPA's VideoFAQ # 417 explains the Rules for Possessing a Firearm in the newly "Constitutional Carry" State of Florida.

Thanks for asking me “What are the Rules about Possessing a Gun in Florida?”

The simplest way to for me explain the rules for lawful possession of a gun in Florida is to say that IF you were to apply for a Concealed Weapons Permit and IF your application were to be approved then since Florida is a Constitutional Carry State you wouldn’t need a CWP to lawfully carry a lawful weapon in a lawful place. Of course this assumes your eligibility so let’s identify disqualifiers. 

DISQUALIFIED PERSONS in FL are those under 21 years old, non- US citizens / legal residents, those without a provable physical ability to safely handle a gun, convicted felons, anyone with a withhold of adjudication for any violent crime less than 3 years after their sentence is complete, those with a record of drug or alcohol abuse (which includes a conviction for violating any controlled substance law and those with multiple arrests for drug offenses), anyone with 2 or more DUI convictions within the past 3 years, those committed to a mental institution, adjudged incompetent or mentally defective, anyone  subject to an injunction for  Domestic Violence or Repeat Violence, anyone who was dishonorably discharged from the Armed Forces, fugitives from justice and those who fail to provide proof of proficiency with a firearm.

DISQUALIFIED WEAPONS in FL include all automatic machine guns, short-barreled shotguns and rifles, “destructive devices” like bombs or grenades, and specific types of ammunition like armor-piercing or exploding bullets.

DISQUALIFIED PLACES in FL include Police, Sheriff and Highway Patrol Stations; detention facilities, prisons and jails, courthouses; polling places; all school and college campus; extracurricular school events like field trips and sport’s competitions, any professional athletic event, all government meetings, be them local, municipal, county, state, school board, special district or other, all bars and some restaurants and upon any federally owned property.

While this video identifies many rules about gun possession in Florida there are exceptions to all of them: for instance while you have to be 21 to buy a gun in Florida an 18 y/o can lawfully possess a rifle; if you have a federal ATF permit then you may be able to possess otherwise disqualified weapons and Judges can pack heat while on the Bench (which is reason # 147 for you to behave in Court).
