Speeding Ticket FAIL! MA Man unsuccessfully argues that a Police Officer had Clocked a Deer on Radar and not his Car ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




A Massachusetts man named Dennis Sayers (I couldn't find a picture of him, sorry) has made the news for violating Honest Abe's sage and age old advise...




Dennis was charged with going 40 mph in a 30 mph speed zone after being pulled over by a West Newbury police officer in mid November, 2016...




and Dennis decided to challenge his speeding ticket (for allegedly traveling in the Newburyport, Massachusetts District Court.



During cross-examination Dennis reportedly asked the cop if he was certain that the radar gun had captured the speed of vehicle as opposed to maybe something else....




No, not a fighter jet...




and no, not a chicken....




Yup... a deer.  In Court on Thursday, January 26th, 2017, a West Newbury, MA police officer reportedly testified that Dennis was going as fast as 51 mph and on cross Dennis reportedly suggested that a deer could have been in the same area, making the reading inaccurate.




The Judge reportedly asked Dennis: "You're not contending the radar picked up the deer?", to which Dennis reportedly replied that anything was possible.




Except for a deer doing 51 - 40 mph... because a deer's maximum velocity is about 30 mph (click here for a link to top speeds for many animals)... the Judge did not buy that a deer running 40 mph was possible, and so the $105.00 ticket was upheld.




Memo to the Folks:  The best defense for any traffic citation anywhere is to hire a local traffic ticket lawyer.  It overwhelming odds are that you, like Dennis Sayers, have about as much business practicing law as I do piloting a space shuttle, meaning none.  Please understand that this is not personal to you.  It is a simple truism in the legal profession. It is very easy to screw up a case when one does not understand the complexities of the rules of evidence and art of cross-examination, and it is also the reason the Honest Abe Lincoln famously said that "he who represents himself has a fool for a client".  Please do not be that fool.
