PLEASE WATCH #HABERPA'S VIDEOFAQ # 415)  What happens when a Witness Lies about me? - https://youtu.be/-BwyZuwcpWY

This Blog Post is intended to serve three purposes: First and foremost it's a PSA (i.e. a "Public Service Announcement" that's designed to provide the folks with important information), it's part of the rollout of the latest batch of #HaberPA's VideoFAQs highlighting # 415)  What happens when a Witness Lies about me? - https://youtu.be/-BwyZuwcpWY and it's a shameless plug for #MichaelHaberLaw (#HaberPA's YouTube channel).  Disclosures complete let's get to it:

- The PSA: #HaberPA's VideoFAQ # 415 explains your options when you feel that a witness has lied and you're paying the price.

Thanks for asking me “What happens when a Witness Lies about me?”

I get this question a lot, it comes in a lot of forms and I have a several thoughts.

Without diving too deeply into the 19th century philosophical framework of “Perceptionism” or “Perceptionalism” (which postulates that individual minds can see the same “truth” differently), it’s been observed that “one man’s truth is another man’s lie”. Of course it’s equally true that “a lie is a lie is a lie”, so maybe in fact you did smack your domestic partner, or perhaps you didn’t but she or he legit thought you did, or possibly your partner had a motive to lie (for example to get you thrown out of the residence or to get a leg up in a divorce or child custody case).

Keeping with the DV illustration, if the Cops are called then the first test of truth vs. fiction is made by Responding Officers who are supposed to (“supposed to”) conduct “an investigation” (meaning that they’re supposed to make visual observations of the scene, the demeanor, speak - or at least attempt to speak - with the parties) and then come to a rational conclusion.

It’s a safe bet that the Cops will identify an “aggressor” and whomever they choose will get arrested and booked (as a relevant aside: Police almost never clear a DV dispatch leaving both parties at the scene so in DV cases it’s all but guaranteed that someone’s going for the ride).

If you’re arrested then you won’t get a chance to plead your case until after you’re charged (which will take weeks and possibly months) but the victim - the “complaining witness” - will be interviewed by a Prosecutor who’s supposed to assess her or his credibility in light of any evidence that the Cops gathered and provided.

If the case moves forward (meaning if the State believes it’s lying complainant and charges you) then vis-a-vis your lawyer you get to challenge those lies. Before a Trial, you can offer proof as to motive to the State, you may be able to take a discovery deposition and during Trial you get to try to expose lies via cross-examination... but in the end it’ll be up others to “perceptualize” what’s truth and what’s fiction.

That said I thank you for your question and I appreciate your having asked it.  Please remember that at #HaberPA it’s all about reasonable doubt and if you like this video then please subscribe to our YouTube channel / VideoFAQ as we’ll be putting out more soon!

PLEASE WATCH #HABERPA'S VIDEOFAQ # 414)  What do I do if my Lawyer Screws Me Over? - https://youtu.be/r6CBAP3fYi8

This Blog Post is intended to serve three purposes: First and foremost it's a PSA (i.e. a "Public Service Announcement" that's designed to provide the folks with important information), it's part of the rollout of the latest batch of #HaberPA's VideoFAQs highlighting # 414)  What do I do if my Lawyer Screws Me Over? - https://youtu.be/r6CBAP3fYi8 and it's a shameless plug for #MichaelHaberLaw (#HaberPA's YouTube channel).  Disclosures complete let's get to it:

- The PSA: #HaberPA's VideoFAQ # 414 explains your options when you feel that your Lawyer has failed to do her / his job on your behalf in your case.

Thanks for asking me “What do I do if my Lawyer Screws me over?”

Common ways that a lawyer can screw you over are:

1) LYING FROM THE GET-GO: Far too many lawyers inflate their profiles, be it online, in person or both, and hold themselves out to be “better” than they actually are, so it’s on you to vet a lawyer before hiring her or him. 2) MAKING UNETHICAL GUARANTEES: All private lawyers are business people who compete with their peers, and sadly many inflate expectations to get paid. While goals should be case specific no lawyer is ever permitted to “guarantee” a specific  outcome in any case. 3) FAILING TO PERFORM AS PROMISED: Like politicians some lawyers can boast “promises made promises kept” - but many can’t. 4) PUSHING FOR A PLEA BARGAIN: Lawyers have an ethical obligation to convey any plea offer and it’s often the best way to resolve many cases but in the end it’s exclusively the client’s choice to make. 6) FAILING TO COMMUNICATE: Lawyers are ethically obligated to keep clients reasonably informed about case status, promptly respond to requests for information, and explain matters so clients can make informed decisions. 7) ASKING FOR MORE MONEY: Having a written retainer agreement should eliminate this problem.

Just like any important relationship - the moment that you notice any issue with your lawyer you’d be wise to address and discuss it, stat. If it’s unresolvable then no matter the “what, why or when” of it, if you feel that your lawyer has screwed you, irreconcilable differences exist and the relationship is irretrievably broken then your options are:

1) You can fire / discharge your lawyer at any time for any reason or for no reason so long as it’s not for an improper reason (for instance firing your lawyer on the day or Trial likely won’t go over well with your Judge) but you may be on the hook for any outstanding fees or costs. 2) You can file a formal grievance with the Florida Bar, a/k/a a “Bar Complaint”, but know that doing so is an effective declaration of war against your lawyer who’s then entitled to defend her or himself against your allegations, sometimes using otherwise privileged or confidential information. 3) You can try to sue your attorney for damages, but legal malpractice claims are notoriously difficult to pursue, much less to win.

That said I thank you for your question and I appreciate your having asked it.  Please remember that at #HaberPA it’s all about reasonable doubt and if you like this video then please subscribe to our YouTube channel / VideoFAQ as we’ll be putting out more soon!

       PLEASE WATCH #HABERPA'S VIDEOFAQ # 413)  What is "Client Confidentiality"? - https://youtu.be/Bo-GspryEu4

This Blog Post is intended to serve three purposes: First and foremost it's a PSA (i.e. a "Public Service Announcement" that's designed to provide the folks with important information), it's part of the rollout of the latest batch of #HaberPA's VideoFAQs highlighting # 413)  What is "Client Confidentiality"? - https://youtu.be/Bo-GspryEu4 and it's a shameless plug for #MichaelHaberLaw (#HaberPA's YouTube channel).  Disclosures complete let's get to it:

- The PSA: #HaberPA's VideoFAQ # 413 first distinguishes between the Attorney-Client Privilege and Client Confidentiality and then explains Rule 4-1.6 of the Rules Regulating the Florida Bar governing Confidentiality of Information.

Thanks for asking me “What is "Client Confidentiality?”

Before I answer it’s important to highlight the significant differences between The Attorney-Client Privilege and Client Confidentiality. “Privilege” is a legislatively created statute found in The Florida Evidence Code which prevents a lawyer from being compelled to disclose confidential communications between the lawyer and her or his client in a Courtroom. “Confidentiality” is a much broader ethics edict found in the Rules Regulating the Florida Bar which protects all aspects of the Attorney-Client relationship, which applies globally, everywhere and to everyone, and not just to privileged communications in a Courtroom.

Rule 4-1.6 of the Rules Regulating the Florida Bar governs Confidentiality of Information and here’s a nutshell summary.

- Lawyers can’t reveal information about a client’s representation unless the client gives informed consent or disclosure is mandated by the rule.

- Lawyer’s MUST reveal confidential information “to the extent the lawyer reasonably believes necessary (1) to prevent a client from committing a crime; or (2) to prevent a death or substantial bodily harm to another.”

- Lawyer’s MAY reveal confidential information “to the extent the lawyer reasonably believes necessary: (1) to serve the client’s interest unless the client specifically says that it isn’t to be disclosed; (2) to establish a claim or defense on behalf of the lawyer in a controversy between the lawyer and client; (3) to establish a defense to a criminal charge or civil claim against the lawyer based on conduct in which the client was involved; (4) to respond to allegations in any proceeding concerning the lawyer’s representation of the client; (5) to comply with the Rules Regulating The Florida Bar; or (6) to detect and resolve conflicts of interest between lawyers in different firms arising from the lawyer’s change of employment or from changes in the composition or ownership of a firm, but only if the revealed information wouldn’t compromise the attorney-client privilege or otherwise prejudice the client.

- If disclosure is mandated or permitted then a lawyer can only disclose the least amount of information possible.

      PLEASE WATCH #HABERPA'S VIDEOFAQ # 412)  What is the "Attorney-Client Privilege"? - https://youtu.be/f-8ym74g0Lk

This Blog Post is intended to serve three purposes: First and foremost it's a PSA (i.e. a "Public Service Announcement" that's designed to provide the folks with important information), it's part of the rollout of the latest batch of #HaberPA's VideoFAQs highlighting # 412)  What is the "Attorney-Client Privilege"? - https://youtu.be/f-8ym74g0Lk and it's a shameless plug for #MichaelHaberLaw (#HaberPA's YouTube channel).  Disclosures complete let's get to it:

- The PSA: #HaberPA's VideoFAQ # 412 explains the boundaries of the Legal Privilege known as "Attorney-Client".

Thanks for asking me “What is the "Attorney-Client Privilege”?”

Before I answer I want to make a few general observations about privileges.

1)  Florida has several legal privileges including Attorney - Client, Accountant - Client, Psychotherapist - Patient, Husband - Wife or  Spousal, Communications to Clergy and others, most of which are found in Chapter 90 of the Florida Statutes, which is known as the Florida Evidence Code.

2) All legal privileges prohibit compelled disclosure of certain communications  in Court (for this reason they can also be called “evidentiary privileges”) and the purpose of all legal privileges is to encourage open, honest communication by protecting specifically delineated confidential relationships.

3)  I’ve done a few other VideoFAQs on privileges, notably # 41) Privileges in FL, Generally - https://youtu.be/sN8d4tSZN84, # 45) 5th Amendment Privilege Against Self Incrimination https://youtu.be/3yAbNDSpD54 # 267) What is FL’s “Accident Report Privilege”? -https://youtu.be/z_p91kerR6o and # 268) FL’s Accident Report Privilege and DUI Cases -https://youtu.be/RpcMDLWv7tg

As to the Attorney-Client Privilege, it’s a strict statutory rule found in Florida’s Evidence Code (specifically F.S. 90.502) which prevents private communications between a client and her or his attorney from compelled disclosure in Court. Key features of the Attorney-Client Privilege include:

1) The privilege belongs to the Client and prevents her or his lawyer from being compelled to testify about private communications.

2 The privilege extends to the lawyer’s legal staff but only apples to communications made in private with a mutual expectation that the information won’t be shared with folks outside of the protected relationship.

3) A Client can waive the privilege either intentionally or inadvertently (an example of a willful waiver is a Client calling her or his lawyer to testify and an inadvertent waiver example is a Client who forwards a confidential email between the client and her or his lawyer to a third party).

4) The Attorney-Client Privilege never expires. It stays in effect after the case is resolved, the attorney-client relationship ends and even after the client dies.

That said I thank you for your question and I appreciate your having asked it.  Please remember that at #HaberPA it’s all about reasonable doubt and if you like this video then please subscribe to our YouTube channel / VideoFAQ as we’ll be putting out more soon!

Each #HaberPA VideoFAQ focuses on a specific question, most are 1 - 2 minutes long, but several in this latest batch are closer to the 3 minute mark (another relevant aside alert: "Necessity" is what we call an "Affirmative Defense", or a defense which negates the "intent" or Mens Rea" element of an otherwise criminal act as the actor's illegal conduct only occurred under threat, usually threat of harm), and while we may not always be successful in our endeavor we do consistently strive to make each VideoFAQ short, pointed, creative, entertaining and, most importantly, informative.

While I conjure some of the "questions" that form our VideoFAQs a substantial portion of them are in fact inspired by real world questions from others (e.g. clients, potential clients, random folks on social media / the internet, friends, family, colleagues, etcetera).  Should you have a legal questions that you'd like #HaberPA to address then you're welcome - encouraged even - to SUBMIT it / them to me, be it by email (Sharky910@aol.com), calling or texting my cell phone (305-798-2220), messaging me on ‪X /‎Twitter, MeWe or Truth Social (@Sharky910), on YouTube (via MichaelHaberLaw) or PM'ing me on FB‬ (Miami.Criminal.Lawyer) and, assuming that your proposed topic is both appropriate and fits within our wheelhouse then I'll be happy to provide you with a custom tailored video answer to your relevant question.
