This Blog Post is a PSA (i.e. a "Public Service Announcement" that's designed to provide the folks with important information) but it also both marks the rollout of this latest batch of #HaberPA's VideoFAQs and highlights # 378) "Are there different types of Warrants?" and finally it's a shameless plug for #MichaelHaberLaw (#HaberPA's YouTube channel).  Disclosures complete let's get to it:


- The PSA:  #HaberPA's VideoFAQ # 379 explains the various exceptions to the Warrant Requirement.  It's the fourth in a quintet (a "quintet" is a grouping of 5) of VideoFAQs that tackle The 4th and goes like this:  





"Thanks for asking me “Are there any exceptions to the “Warrant Requirement”?


Yes.  There are plenty of them.   The 4th Amendment itself delineates 3 absolute requirements for any warrant to be valid: 1) Specificity - or “particularity”, 2) Probable Cause - or the mandatory presentation of sworn facts establishing the legal basis for the warrant that’s being sought; and 3) An impartial check valve - or that an unbiased Judge or Magistrate make the call.


That said we’ve gotta remember that the 4th became law in the late 18th century, since then time has ticked, our County has expanded, our population has exploded, the 18th century turned into the 19th and technological advancements such as the telegraph (in 1836), the telephone (in 1876), the camera (in 1888) and the automobile (1895) were game changers.  As the 19th, century turned into the 20th we continued to blossom, be it geographically, in terms of population and also with more rapid advancements in terms of technology.  More people, more goods and more access, coupled with more impressive inventions - such as the airplane (1903) and the silicon chip (1961) - saw corresponding innovation in criminality, resulting in a need for more law enforcement and more courts.  


From a strictly mathematical point of view, in the past 230+ years the number of laws, people and crimes have dramatically risen, and so too have the number of searches and seizures.  It’d be impossible for the cops to seek a warrant each and every time they want to detain someone (for example whenever they conduct a routine traffic stop) or to effectuate avery arrest, or when they want to do a “protective sweep”(like a Terry stop / “limited pat-down”), much less a full blown search.  So, as our County has grown our Courts have “interpreted” our Constitution to fit the times, and a nice chunk that interpretation has been to “carve out” a variety of exceptions to the 4th Amendment’s warrant requirement.  


I’ll rattle off the SCOTUS-recognized “biggies” in alphabetical order):  Borders,  Consent,  Exigent Circumstances, Foreign Intelligence Surveillance, Found / Abandoned Property, Incident to Arrest, Inventory, Inevitable Discovery, Motor Vehicles, Officer Safety Plain View, Prisons and Schools.  Where the facts and circumstances of a given case fall into one of these carved-out exceptions (or where they constitute a new exception) no warrant will be required."

"Thanks for asking me “Are there different types of Warrants?”


Yes, there most definitely are different types of warrants, but before we discuss the differences let’s first define the word “warrant” and examine the similarities.


For 4th Amendment purposes a “warrant" refers to “an authorization issued by a competent officer, usually a judge or magistrate, which permits an otherwise illegal act that would violate individual rights”.  I know that that’s a lot of legal mumbo jumbo, so let me restate: A warrant is a document that evidences formal, judicial approval of specific, limited action, by the government, against a citizen.


Now that we know what a warrant is, regardless of the type in order be legal any warrant must share three common denominators: 1)  They must all be specific - or exhibit “particularity”, 2) they must all issue upon sworn facts that establish Probable Cause & 3) a truly impartial arbiter must make the call.


Okay, so what are the differences? The biggest contrast is seen in arrest warrants versus search warrants.  An arrest warrant authorizes the seizure of a specific individual for a specified crime, whereas a search warrant authorizes the inspection of a specific location for specified items of evidence for a specific crime (either way of note is the “specificity / particularity” requirement).


While there’s only one variety of search warrant, arrest warrants take many different forms.  For instance, there’s the garden variety arrest warrant (where a Cop asks a Judge X for permission to arrest citizen Y for committing crime Z) but there’s also “Bench Warrants”, which, as their name suggests, issue from the Bench but differ from traditional arrest warrants in that bench warrants are NOT supported by sworn testimony and usually have nothing to do with a new crime (rather they usually issue for a Failure to Appear).  The same holds true for an "Alias Capias" (also a FTA / “Failure to Appear” warrant), which also issues from the Bench and applies to someone who’s already been arrested.  Criminal Judges also issue Fugitive warrants (a/k/a extradition warrants) and Probation Warrants, while Family Court Judges issue “Writs of Bodily Attachment” for delinquent support payments.  In addition to these there are a variety of detainers, or holds, which can be administratively placed and serve as de facto arrest warrants, for example an ICE or an Immigration hold."

- The PSA:  #HaberPA's VideoFAQ # 377 explains  "the what" of The 4th Amendment's Warrant Requirement.  It's the second in a quintet (a "quintet" is a grouping of 5) of VideoFAQs that tackle The 4th and goes like this:  






"Thanks for asking me “What is the 4th Amendment “Warrant Requirement”?”  Before I can answer that question it’s important to understand what a warrant is: A  warrant is a Court Order authorizing law-enforcement to conduct either a search, a seizure or an arrest.    


The  “Warrant Requirement” is found in the 4th Amendment to the United States Constitution and says, verbatim: “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”


The US Constitution was written in 1787, ratified in 1788, effective in  1789, and it’s 1st 10 Amendments - which are collectively known as “The Bill of Rights” and which include The 4th and it’s “Warrant Requirement” - were enacted in 1791.  At that time our newly founded country was celebrating it’s independence from the British Crown, and this included any of a number of whimsical dictates by King George III, but for our purposes most especially a little ditty known as a "Writ of Assistance".  This Writ was effectively a generalized and non-specific search warrant routinely issued by the British government and executed on colonial soil, The 4th Amendment’s “Warrant Requirement” was specifically intended to serve as a check-valve against this sort of totalitarian action by establishing an absolute presumption of illegality for any search, seizure or arrest which was performed without a preexisting and valid warrant; but it also constructed a constitutional protocol by which warrants would necessarily issue.


In order to secure a lawful and valid warrant, sworn facts would first have to be presented to a “neutral and detached” magistrate, who would then have to conclude that those fact established “Probable Cause” before issuing either a search or an arrest warrant -which itself would have to be strictly tailored - or limited - to “the place to be searched, and the persons or things to be seized.”


In the 230+ years since it’s inception the 4th has been interpreted, modified and many “exceptions” to the warrant requirement have been carved out."

- The PSA:  #HaberPA's VideoFAQ # 376 offers a brief history of "the why" of The 4th Amendment's Warrant Requirement.  It's the first in a quintet (a "quintet" is a grouping of 5) of VideoFAQs that tackle The 4th and goes like this:  




"Before we won our independence from the British Crown, the United States was nothing more than a series of colonies, populated by folks who’d traversed the Atlantic Ocean, many fleeing King George, III’s tyrannical rule. Yet 3,000 nautical miles later these folks found themselves still subject to the imperiousness of that Monarch.  After a prolonged, bloody war we won our freedom - or, as some say, "'ole Uncle Sam was born".  We secured our independence and enacted our Constitution to establish a protocol for how our new Kingless Country would be governed.


Our Founding Fathers and Founding Mothers were wicked smart, drafting the U.S. Constitution with foresight and benevolence; but, they didn't get it absolutely correct in it's first draft, and modifications were required.  In fact, because of some of it’s omissions, several Colonies opposed the Constitution’s ratification, only agreeing to endorse it because additions, or amendments, were agreed to in advance (as an aside today we call this a "condition precedent").


The 4th is 1 of the first 10 Amendments, collectively known as "The Bill of Rights", and it was added to the Bill of Rights on December 15, 1791 as a direct response to the King’s abuse of something called a "Writ of Assistance" - a "Writ of Assistance" being a generalized, non-specific #SearchWarrant that was routinely issued by the British government, executed on colonial soil and was a significant source of tension in the mid to late 18th century.  The 4th made it crystal clear that the "King's privilege" - meaning that British soldiers could enter, search, seize and secure wherever, whenever and "whyever" - even on a mere whim - wasn’t gonna fly anymore.  The 4th manifestly prohibited our new government from acting as a de facto King and also served as a check-valve against any government search or seizure unless a warrant, based upon Probable Cause, was first issued by a “neutral and detached” magistrate.

  

Of course the 18th century turned into the 19th, and then the 20th and now the 21st, and our Constitution has been and will continuously be interpreted as the times continue change"
