What to do about a lawyer who doesn't respond to me and failed to show at a hearing? ~ Chosen as Best Answer on AVVO ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Q:   Bad Attorney or something else?  I'm involved in a very ugly paternity case that has dragged on for 16 months, and I am on my 3rd attorney. With the first two, I had limited income and made the mistake of getting the cheapest counsel I could find. I got what I paid for. Borrowed money from my parents for this third attorney who came highly recommended however he has done absolutely NOTHING since April. He doesn't answer questions, emails, was a no show for a phone conference, and even failed to inform me of a hearing that had been scheduled. I got a call the day of the hearing and of course there was no way I could make it. He basically told me if I forked over several hundreds to the opposing side, a stipulated order could be done and the matter would be resolved. I was furious and felt taken advantage of. I've been more than patient and have contacted him once a month, if that. I have a support order that needs to be adjusted due to change of income, I've asked him 3 times in the last three months without any response. This whole process has been very emotional and depressing and I fear that no new attorney would ever want to be the 4th attorney on a case. What should I do? Is this grounds to file a complaint?

Why did you list this as a criminal defense question?  If it is a paternity case then it is a paternity law question.  As AVVO does not have a "paternity" category I suggest that you rep-post your question in either the "family" or the "child support" category.

That said and regardless, here's the bottom line: If you feel that your lawyer has failed to perform ethically or has otherwise violated his oath as a lawyer then you should file a grievance with the Florida Bar and let them decide if your complaint(s) has (have) merit.

Lake County, FL Sheriff w/ Balaclava-Clad Deputies Issues Tough Social Media Threat to Heroin Dealers via Facebook Video ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




Meet Lake County, FL Sheriff Peyton Grinnell.  That's him below....




On April 7th Sheriff Grinnell, flanked by four (4) members of his SWAT team wearing balaclavas and dressed in black paramilitary-style garb, took to Facebook (you can access the Lake County, FL Sheriff's Department Facebook page by clicking here) to issue a stern warning to local heroin dealers.




The video (which you can watch by clicking here) is a mere 1:24 but Sheriff Grinnell, staring directly into the camera, delivered a strong and unmistakable message: "Over the last month or so I've had several phone calls from citizens in this county concerned about the number of overdoses related to heroin. I want our citizens to know that I am aware of this serious issue. I am asking our residents to please call and let us know if you know of a location that this poison is being pushed out to our streets. You can remain anonymous.  To the dealers, who are pushing this poison, I have a message for you, we are coming for you. As a matter of fact, our undercover agents have already bought heroin from many of you. We are simply awaiting the arrest warrants to be finalized. So, to the dealers I say, enjoy looking over your shoulder constantly wondering is today the day we come for you.  Enjoy trying to sleep tonight wondering if tonight's the night that your SWAT team blows your front door off its hinges. We are coming for you. If our agents can show the nexus between you the pusher of poison and the person who overdoses and dies, we will charge you with murder. We are coming for you. Run."  And with that then the law men quickly make their exit, stage left.  




This is not the first video of it's sort.  In February, 2016 I authored a blog post (which you can view by clicking here) about a Louisiana Police Caption (Clay Higgins) of St. Landry Parrish who, like Sheriff Grinnell, taunted a local street gang (the Gremlins) in a Facebook video challenge while he was flanked by heavily-armed officers.




Memo to the Folks:   Law enforcement uses social media for a variety of reasons, and they range from sting operations to public service announcements.  But when they come out and directly tell you that they are gunning for you, well, you'd be well-advised to pay attention.

Smuggling FAIL! A Fake "Dead-Heading" Pilot is Arrested for Trafficking when 5 Lbs.of Cocaine is found in his Luggage ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1

Well US-CBP caught Mario Hudson, a Jamaican citizen, on March 27th, 2017 when he landed at JFK Airport from Kingston, Jamaica, even though Mario was reportedly dressed in a pilot's uniform and had claimed to be a 'dead-heading crew member.'




During baggage inspection CBP discovered that Mario's bag had fake Delta Airlines tags (he also reportedly had fake airline ID badges) and when officers checked the luggage they noticed that the sides and bottom appeared to be "unusually thick and heavy", prompting a visit to a "private search room".




Further inspection of the luggage revealed 5 lbs. of cocaine worth about $85,000.00.




Memo to the Folks:  Not that I recommend smuggling anything, anywhere at anytime, but if you are going to try to sneak one past law enforcement (especially at a border) then you'd best be a hell of a lot more creative than Mario Hudson.  Not unlike your parents, US-CBP (as is the case with most experienced law enforcement agencies and officers) has pretty much seen it all.

NY Congressman Forwards Tip to Cops Leading to Arrest of Sex Offender who was Living next to School w/ 2,500 Students ~ Call Michael A. Haber, Esq. @ 1-888-SHARK-8-1




If you're like most folks then you believe that your elected congresspeople are essentially worthless, but NY State Senator Jeff Klein (Bronx) has proven this generally accurate principal false (at least in this case)....



When the NY-Alert System notified his office that 50 y/o Arthur Ceasar, a sex offender who was convicted of raping and sodomizing a 15-year-old girl in 1993, had moved into his district Senator Klein got on the phone with NYPD and asked them to verify Ceasar's status.




Ceasar was freed from prison in 2001, is no longer on probation or parole (** in NY this means that he was no longer barred from living in proximity to children as that restriction only applies to sex offenders who are presently under supervision and it expires contemporaneous with the offender's supervision... but sex offenders remain subject to a requirement that they register their accurate residential address forever), but Ceasar remains listed as a "Level 3 sex offender", meaning that he poses a "high risk of repeat offense and a threat to public safety" (and therefore was obligated to continue to report accurate and current residential information, which he failed to do).




Had he simply registered his address properly then Cessar could have lawfully resided in the tower apartment building located at 1965 Lafayette Avenue in the Bronx...




even though the tower overlooks the Bronx's Adlai Stevenson Educational Campus, which houses about 2,500 students, and not withstanding how many kids may live in the tower building itself.




However, as it turns out, while Ceasar had reported his correct street address, for reasons unknown he lied about his zip code, claiming "10469", which is some 5 miles north of his actual home in the south Bronx.




After Sen. Klein’s office informed the NYPD Ceasar was arrested for failure to verify his address.



So, props to NY State Senator Jeff Klein of the Bronx, as well as to the NY-Alert System (which, among other things - like Amber Alerts or weather warnings - alerts users when a sex offender moves into or out of their area), but how's about tweaking the law which would have allowed Ceasar to live across the street from the Adlai Stevenson Educational Campus had he simply correctly reported his address?
